RESOLUTION AMENDING RESOLUTION OF INTENTION IN THE
MATTER OF THE PROVISION FOR DISTRIBUTION OF SURPLUS
FUNDS IN EAST SAN RAFAEL ASSESSMENT DISTRICT NO. 2,
CITY OF SAN RAFAEL, MARIN COUNTY, CALIFORNIA
BE IT RESOLVED that Resolution of Intention No. 2959 adopted
by the City Council of the City of San Rafael on the 20th day of
January, 1964 in East San Rafael Assessment District No. 2, City of
San Rafael, Marin County, California, be, and it is hereby, amended
by deleting therefrom the following language:
"BE IT FURTHER RESOLVED that if any excess shall
be realized from the proceeds of the assessment
and/or bonds issued to represent the same, it shall
be applied as a credit to each assessment levied
pursuant to said provisions of the Municipal
Improvement Act of 1913 in proportion to the amount
of each of said assessments",
and substituting therefor the following language:
"BE IT FURTHER RESOLVED that if any excess shall
be realized from the proceeds of the assessment
and/or bonds issued to represent the same, it shall
be used for the maintenance of the improvements
constructed and acquired in said assessment district
in accordance with the provisions of Section 10427(c)
of the Streets and Highways Code of the State of
California."
I HEREBY CERTIFY that the foregoing Resolution was duly and
regularly adopted by the City Council of the City of San Rafael,
Marin County, California, at a regular meeting thereof held on the
19th day of May, 1975, by the following vote, to wit:
