RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL ORDERING ABATEMENT OF A NUISANCE
WHEREAS, pursuant to Title 1, Chapter 1.20, Sections 1.120.060, 1.120.070
and 1.120.080 of the Municipal Code of the City of San Rafael, Mr. and Mrs. Robert D.
Lewis were notified certain conditions on the premises which they own, situate in the
City of San Rafael, State of California, known and designated as 1222 Grand Avenue,
in said City, and more particularly described as Marin County Assessor's Parcel
No. 14-054-26, constitute a public nuisance; and
WHEREAS, pursuant to Section 1.20.090 a hearing was duly held before the
City Council of the City of San Rafael; and
WHEREAS, said hearing was held on June 16, 1975, and after considering the
oral and written evidence presented,Council determined that:
Mr. and Mrs. Robert D. Lewis have in the past and now are maintaining
front and side yard in such a negligent manner as to create an eyesore to their im-
mediate neighborhood which is detrimental to neighbors' property values, a danger
to small children, and unsightly to passerbys. It is specifically noted that a
tractor, washing machines,and two -wheeled trailer is in your front yard. Addition-
ally, abandoned vehicles have been stored in your side yard, visible from the street.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Rafael, pursuant to Section 1.20.110 does hereby declare a public nuisance
exists on said premises and that there is sufficient cause to abate same;
BE IT FURTHER RESOLVED that the Owner(s) having charge of control of
said premises shall abate such nuisance by removing all of said items from the front
and side yards.
BE IT FURTHER RESOLVED that the Owner(s) of said premises shall commence
abatement upon receipt of a copy of this Resolution and abatement shall be com-
pleted within thirty (30) calendar days of receipt of said Resolution.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that
the foregoing Resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City held on Monday the 16th day of
June , 1975, by the following vote, to -wit:
AYES: COUNCILMEN: Jensen, Miskimen, Nixon and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Mulryan
