HomeMy WebLinkAboutResolution No. 4988RESOLUTION NO. 4988 A RESOLUTION AUTHORIZING THE SIGNING OF FEDERAL -AID URBAN SYSTEM PROJECTS PROGRAM SUPPLEMENT NO. 1 THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES a, follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the Cit, of San Rafael, Federal -Aid Urban System Project Supplement No. l with the STATE OF CALIFORNIA, a copy of which is hereby attached and by this reference made a part hereof. I, MARION A. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by City of San Rafael at recular intervals or as required for efficient operation of the completed improvements. 2. This project is No.3 on the County priority list for 1971-72 and 1972-73 FAU Funds. Should higher priority projects cause increase or decrease to the Federal funds available, this project will be financed with the remaining 71/72, 72/73 Federal funds. The present available FAU funds are 6703M DH -OLA -412 (1-75) approximately $190,009. Exhibit B Continued - Page 2 i 3. The remaining FAU funds for this project are from the 3 year FAU Program of the 1973 Highway Act. The use of these funds is based on the project being part of the three (3) year FAU Program for Marin County's portion of the San Francisco -Oakland Urbanized Area. J 'c 4. Unless determined otherwise by Marin County's Cooperative Process Committee, the actual funds for the project will be set up on the basis of contract prices after the bids for the work have beenopened. In awarding, or agreeing to award the contract, the City agrees to use maximum Federal Funds based on bid prices as established in the Detail Estimate and accepts any increase in Local Agency Funds. 5. Should higher priority projects cause increase or decrease to the Federal funds available, this project will be financed with the maximum Federal funds available to the County. - 6. Should additional Federal Funds become available to the City, this amount will, at the City's request, be increased to the amount available but not to exceed the maximum legal Federal prorata share with a corresponding decrease in the matching funds. 7. The City share of matching funds for Construction Engineering will be 100% of the amount remaining after Federal participation for the 71/72, 72/73 portion of the project and 100% City funds for the remainder of the project. 8. The City share of matching funds for Construction will be 1007. of the amount remaining after Federal participation. 9. The City agrees to: a) To advertise, award and administer the project and bear the entire cost thereof. b) To pay State promptly upon receipt of monthly billing thereof, the amount of the State's expenses that were incurred on behalf of the City for construction surveying expenses. C) The State's expenses for furnishing a construction surveying party for the project is estimated to be $40,000. The actual cost to the City will be computed monthly.as set forth below: (i) City will reimburse State for salaries or wages of State personnel loaned to the City, plus the assessment for indirect charges at the current rates. (ii) City will reimburse State for the actual direct costs for materials, supplies, equipment, etc. that are required for the project. (iii) City will deposit with the State $10,000 prior to the State incurring any expenses on behalf of the City. U 0 Exhibit B Continued - Page 3 d) That should State incur any additional expenses on behalf of City pursuant to constructicn surveying expenditures, referred to herein, which is not specifically defined under provi- sions set forth in this agreement, said additional expense incurred on behalf of City will be borne at the City's sole expense. e) To provide a Resident Engineer, construction inspectors and pay contractor for the project. 10. The State Agrees to: a) To loan City a construction survey party for the FAU project M-6302(001) 4th Street - Miracle Mile. b) To furnish City monthly with a detailed statement of billing for the actual cost that was accumulated by State pursuant to this agreement. 11. In accordance with Section 86-3.01 of State Standard Specification for testing controllers, the City agrees to pay their share of the cost of testing. 12. The availability of Federal Funds will be subject to meeting deadlines and/or other conditions as may be imposed by the Director upon the reco=- endation of the TOPICS Advisory Committee (Urban System). 13. Exhibit "C", attached hereto, supplements the aforementioned Master Agreement in'regard to the 1973 Federal -Aid Highway Act. r 6.1.. MULIUM 1 I L1 I 11%J. 7 FAU AGREFNENT EXHIBIT "C" 1973 FEDERAL -AID HIGHWAY ACT SUPI'LLNENT : All references to the Federal -aid Highway Act of 1970 in thi.:, agreement shall include the Federal -aid Highway Acts of 1970 and 1973. The Federal -aid Highway Act of 1973 expanded the Federal --aid Urban System program to: Include urban areas with populations between 5,000 and 50,000. The use of the term urbanized in this agreement shall mean urban when this agreement covers prl�jocts ill areas having between 5,000 and 50,000 population. Provides for the expenditure of Urban System fonds OTi mass transit projects. This agreement shall be deemed to cover projects of this nature. This exhibit deletes or revises specific paragraphs of the agreement as follows: . Article I, paragraph I - revise to read: "All projects, excepting mass transit projects, must- be on an approved Federal -aid Urban System route." . Article II, paragraph 2b - delete. Article II, paragraph 2c - revise to read: "The project selected by a cooperative process, and included in the area's approved 3 -year program." . Article II, paragraph 3 - delete. -11- CT SAC 6-14 50
