HomeMy WebLinkAboutResolution No. 4993RESOLUTION NO. 4993 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DECLARING ITS INTENTION TO CALL A SPECIAL ANNEXATION ELECTION, AND FIXING A TIME AND PLACE FOR PROTESTS BY PROPERTY OWNERS WHEREAS, on the 21st day of July , 1975, a petition proposing that new territory, hereinafter described, be annexed to the City of San Rafael was duly received by the City Council; and WHEREAS, said petition is signed by not less than one-fourth of the qualified electors residing within said described territory as shown by the county registration of voters; contains said description of the new territory and asks that said described new territory be annexed to the City of San Rafael. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael as follows: 1. That it is the intention of the City Council of the City of San Rafael to call a special election to be held in certain inhabited territory contiguous to said City, proposed to be annexed thereto, for the purpose of submitting to the qualified electors residing in said territory the question whether or not said territory shall be annexed to the City of San Rafael, and the property in the territory subjected to taxation after annexation equally with property within the City of San Rafael to pay the bonded indebtedness of the City of San Rafael outstanding or authorized, at the date of the first publication of the notice of election, for the acquisition, construction or completion of municipal improvements, with the exception of 1971 General Obligation Bonds for Sewers Said territory is described in Exhibit "A" attached hereto. 2. That said territory hereby is designated and identified as "San Rafael Meadows Annexation" and shall be so designated and referred to upon the election ballots. 3. Notice hereby is given that on the 5th day of August, 1975, at the hour of 5: 00 p . m . , in the Council Chamber of the City Hall of the City of San Rafael, any person owning real property within said territory so pro- posed to be annexed and having any objection to the proposed annexation may appear before said City Council concerning written protest against the annexation filed pursuant to the law for filing such protests. Such protests must be in writing, must be filed at any time not later than the hour set for hearing objections tb the election and show the name or names of the owner or owners of the property affected by such annexation and the - 1 - street address or other description of the property sufficient to identify it on the last equalized assessment roll. Protests may be made by petition, forms for which are available upon request at the office of the City Clerk. 4. That the City Clerk shall certify to the adoption of this resolution and cause the same to be published in the Independent -journal once a week for two successive weeks prior to the hearing. GRADY, City C14k -2-- EXHIBIT "A" DESCRIPTION OF SAN RAFAEL AEADOIVS AINNEVITION TO THE CITY OF SAN RAFAEL Beginning at a point on the existing San Rafael City limit line, said point being the intersection of the courses S 56° 34' 30" IV and N 7° 57' 00" Id, 287.39 feet; said intersection being the most southerly corner of the parcel described in Book 1758 of Deeds, at page 429, Marin County Records; thence leaving said existing San Rafael City Limit line, and proceeding N 56' 34' 30" E, 330.45 feet to the westerly line of Ranchitos Road, said point being the most northerly corner of Lot 21 as shown on Record of Survey, Book 2, page 116, Amended Record of Survey of Los Ranchitos, Marin County Records; thence along the westerly line of Ranchitos Road, along a curve to the right with a radius of 970 feet for a distance of 51.767 feet, as said line is described in Book 192 of Deeds, at page 20, Marin County Records; thence S 890 55' E, 60 feet more or less to a point on the easterly line of Ranchitos Road, said point being 30 feet easterly of the intersection of the centerline courses R=1000 feet, L=250.75 feet, and S 0° 05' IV, 269.79 feet, as said centerline is de- scribed in Book 192 of Deeds, at page 20; thence along said easterly right of way line as described by the roadway centerline, S 0° 05' IV, 269.79 feet; thence along a curve to the left, tangent to said last named course, with a radius of 1040 feet for a distance of 1482.06 feet; thence S 83° 46' E, 722.69 feet; as said course is described in Book 192 of Deeds, at page 20; thence along said right of way, curving southeasterly to the right along a curve with a radius of 1660 feet for a dist-r_ce of 1126.55 feet more or less; thence con- tinuing along the northerly line of Ranchitos Road, 60 feet northerly of the centerline, as said northerly line is described by the centerline description conunencing at a point on the centerline knoi.n as Sta "LI" 877+04.87 P.T.; thence -'[Continued)-' S 390 42' E, 359.10 feet; thence curving to the left tangent to said last named course with a radius of 300 feet for a distance of 421.06.feet; thence N 590 53' E, 50 feet more or less to a point of intersection of the following two courses: S 61° Ol' 06" N, 65.00 feet and S 28° 58' S4" E, 119.99' as said courses are shown on the State of California, Highway 101, Right of Nay Record Map, R.87.7, said point of intersection being on said State of California Right of Way; thence leaving the northerly line of Ranchitos Road and crossing to the southerly line thereof, along said State of California Right of Nay, S 28° 58' 54" E, 119.99 feet; thence S 61° O1' 06" N, 49.35 feet; thence leaving said right of way, S 40° S3' S4" E, 70 feet more or less to intersect the course, N 660 30' E, 198.0 feet, said course being on the existing San Rafael City Limit line; thence proceeding northeasterly, northwesterly and southeasterly along the existing San Rafael City Limit line to_the point of beginning.
