RESOLUTION REMOVING ONE (1) FOOT NON -ACCESS STRIP FROM THE NORTH-
WESTERLY TERMINUS OF BUTTERNUT DRIVE AS SHOWN ON THE RECORD SUB-
DIVISION MAP OF "TERRA LINDA UNIT 24" AND ESTABLISHING A NEW ONE
(1) FOOT NON -ACCESS STRIP ALONG THE SOUTHEASTERLY BOUNDARY OF
"TERRA LINDA UNIT 26" ADJACENT TO MANUEL T. FREITAS PARKWAY
WHEREAS, the San Rafael Planning Commission and City Council have hereto-
fore approved the subdivision map of "Terra Linda Unit 24";
AND WHEREAS, said subdivision map of "Terra Linda Unit 24" was recorded on
March 10, 1966 in Volume 13 of Maps at Page 59, Marin County Records;
AND WHEREAS, the Record Subdivision Map of "Terra Linda Unit 24" in the
City of San Rafael, shows a one (1) foot non -access strip adjacent to the north-
westerly terminus of Butternut Drive;
AND WHEREAS, MICHAEL J. SMITH AND CARLOS E. GONZALEZ, SUBDIVIDERS OF TERRA
LINDA UNIT 26, have requested that said one (1) foot non -access strip be removed
to allow access to the proposed Terra Linda Unit 26 Subdivision at the end of
Butternut Drive;
AND WHEREAS, said one (1) foot non -access strip would preclude access to
the proposed Terra Linda Unit 26 Subdivision;
AND WHEREAS, it is to the benefit of the public that said one (1) foot non -
access strip be removed;
AND WHEREAS, the San Rafael Planning Commission required as a condition of
approval of Terra Linda Unit 26 that a new one (1) foot non -access strip be estab-
lished along the southeasterly boundary of Terra Linda Unit 26, across lots three
and four to the City Limit line, and adjacent to Manuel T. Freitas Parkway;
AND WHEREAS, said new one (1) foot non -access strip would preclude access
to Terra Linda Unit 26 from Manuel T. Freitas Parkway;
NOW, THEREFORE, BE IT RESOLVED THAT that certain one (1) foot non -access
strip adjacent to the northwesterly terminus of Butternut Drive as shown on the
recorded Subdivision Map of "Terra Linda Unit 24" be and the same is hereby removed;
AND, BE IT FURTHER RESOLVED that a new one (1) foot non -access strip be estab-
lished along the southeasterly boundary of the Terra Linda Unit 26 Subdivision,
across lots three and four to the City Limit line, and adjacent to Manuel T. Freitas
Parkway.

and adopted at a REGULAR meeting of the Council of said
City on MONDAY , the 6TH day of OCTOBER
