RESOLUTION OVERRULING PROTESTS, EAST SAN
RAFAEL DRAINAGE ASSESSMENT DISTRICT NO. 2,
CITY OF SAN RAFAEL, MARIN COUNTY, CALIFORNIA
WHEREAS, on the 4th day of February, 1974, the City
Council of the City of San Rafael, Marin County, California, adopted
its resolution fixing time and place for hearing on the Engineer's
Report in East San Rafael Drainage Assessment District No. 2, City of
San Rafael, Marin County, California; and
WHEREAS, said resolution fixed the 18th day of March,
1974, at the hour of 8:00 o'clock P.M. of said day, at the meeting
place of the City Council of the City of San Rafael, located in the
City Hall, 1400 Fifth Avenue, San Rafael, California, as the time and
place for hearing protests with relation to the proposed improvements
and acquisitions to be made as described in the Engineer's Report,
the grades to which the work will be done, the extent of the assessment
district, the assessment or the Engineer's Estimate of Cost and expenses,
or any other act or determination of the Engineer of Work of said assess-
ment district; and
WHEREAS, protests or objections were filed in writing by
certain persons, firms or corporations who were interested in certain of
the property within the boundaries of said district, which said protests
or objections were delivered to the City Clerk not later than the hour
set for hearing such objections; and
WHEREAS, at the time set for hearing the protests and
objections, said City Council of the City of San Rafael continued the hear-
ing, and said hearing has been continued from time to time to the 4th
day of November, 1974, at the hour of 8:00 o'clock P.M. of said day; and
WHEREAS, on the 7th day of October, 1974, the City Council
of the City of San Rafael adopted its resolution and order preliminarily
adopting the Second Amended Engineer's Report and set a public hearing thereon
for the 4th day of November, 1974, said hearing to be held on certain

changes and increases to be made; and
WHEREAS, on the 4th day of November, 1974, said hearings
were held and all of the protests or objections of every kind and nature
having been heard and duly considered;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Coun-
cil of the City of San Rafael, Marin County, California, that all of the
said protests and objections of every kind or nature be, and the same
are hereby, overruled or denied; and
IT IS HEREBY FURTHER RESOLVED that the City Council finds
that said protests and objections are made by the owners of less than
one-half of the area of the property to be assessed for said improvements
and acquisitions.
I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the City Council of the City of San Rafael,
Marin County, California, at a regular meeting thereof, held on the
4th day of November, 1974, by the following vote, to wit:
AYES: Councilmen Jensen, Miskimen and Mulryan
NOES: Councilmen None
ABSENT: Councilmen Nixon and Mayor Bett i n i
