RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN RAFAEL DECLARING
THE RESULTS OF THE CANVASS OF THE ELECTION RETURNS
OF AN ELECTION HELD ON THE ANNEXATION TO THE CITY
OF SAN RAFAEL OF CERTAIN INHABITED TERRITORY
DESIGNATED AS "COUNTRY CLUB ANNEXATION", ON THE
5th DAY OF NOVEMBER, 1974.
WHEREAS, pursuant to the provisions of the Annexation Act
of 1913, and pursuant to Resolution No. 4793 adopted by the City
Council of the City of San Rafael on the 5th day of August ,
197 4 , a special election was held on the 5th day of November,
1974, in inhabited territory contiguous to the City of San Rafael
designated as "Country Club Annexation"; and
WHEREAS, at said special election the following question was
submitted to the qualified electors residing in said territory:
SHALL THE TERRITORY KNOWN AND DESIGNATED AS THE
"COUNTRY CLUB ANNEXATION" BE ANNEXED TO THE CITY
OF SAN RAFAEL, AND THE PROPERTY IN SUCH TERRITORY BE,
AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY
WITH THE PROPERTY WITHIN THE CITY OF SAN RAFAEL TO
PAY THE ENTIRE BONDED INDEBTEDNESS OF THE CITY OF
SAN RAFAEL OUTSTANDING OR AUTHORIZED AT THE DATE OF
THE FIRST PUBLICATION OF NOTICE OF ELECTION, FOR THE
ACQUISITION, CONSTRUCTION OR COMPLETION OF MUNICIPAL
IMPROVEMENTS, AND THE CITY OF SAN RAFAEL IMMEDIATELY
UPON ANNEXATION OF SAID TERRITORY COMMENCE THE FORMATION
OF A SPECIAL ASSESSMENT DISTRICT IN SAID TERRITORY FOR
THE PURPOSE OF UPGRADING THE WATER DISTRIBUTION SYSTEM
WHERE NECESSARY; THE COST OF SAID UPGRADING TO BE AP-
PORTIONED IN RELATION TO THE BENEFIT RECEIVED BY EACH
PROPERTY OWNER IN SAID TERRITORY.
WHEREAS, the returns of said election were duly canvassed
by the County Clerk of the County of Marin, a copy of said

canvass is attached hereto, and is hereby adopted by the City
Council of the City of San Rafael at its Council. Chambers on
the 18th day of November, 1974, at its regular meeting on said
day;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF SAN RAFAEL AS FOLLOWS:
1. That the canvass of said returns as adopted by the City
Council of the City of San Rafael, finds the same to be as follows:
Number of votes cast . . . . . . . . . . . . .
Number of votes in favor of the annexation
of "Country Club Annexation" to the City
of San Rafael, and shall the property in
such territory be, after such annexation,
subject to taxation equally with the property
within the city of San Rafael to pay the entire
bonded indebtedness of the City of San Rafael
outstanding or authorized at the date of the
first publication of notice of election, for
the acquisition, construction or completion
of municipal improvements, and the City of
San Rafael immediately upon annexation of said
territory commence the formation of a special
assessment district in said territory for the
purpose of upgrading the water distribution
system where necessary; the cost of said up-
grading to be apportioned in relation to the
benefit received by each property owner in

Number of votes against the annexation of
"Country Club Annexation" to the City of
San Rafael, and shall the property in such
territory be, after such annexation, subject
to taxation equally with the property within
the City of San Rafael to pay the entire

2. The City Clerk shall certify to the adoption of this
resolution.
Adopted this 2nd day of December, 1974, by the following
