RESOLUTION REJECTING ALL CONSTRUCTION BIDS
AND DIRECTING READVERTISEMENT FOR CONSTRUCTION
BIDS, EAST SAN RAFAEL DRAINAGE ASSESSMENT
DISTRICT NO. 2, CITY OF SAN RAFAEL, MARIN
COUNTY, CALIFORNIA

WHEREAS, on the 19th day of September, 1974, the City Clerk
of the City of San Rafael, Marin County, California, received bids for
the construction of improvements in East San Rafael Drainage Assessment
District No. 2, City of San Rafael, Marin County, California; and
WHEREAS, specifications on file in said proceedings provided
that the award of contract for the construction work must be made within
ninety (90) days after the receipt thereof; and
WHEREAS, the condition precedent to the performance of the con-
struction work has been the issuance of a permit by the Army Corps of
Engineers; and
WHEREAS, said permit had not been issued within the ninety (90)
day period provided for the award of the construction bid; and
WHEREAS, the low bidder has informed the City of San Rafael
of his refusal to enter into a contract for the performance of said
work by reason of the expiration of the ninety (90) day period;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of San Rafael, Marin County, California, as follows:
1. That all construction bids received on September 19, 1974
for the doing of the work in East San Rafael Drainage Assessment
District No. 2, City of San Rafael, Marin County, California, are hereby
rejected,and the City Clerk of the City of San Rafael is hereby author-
ized and directed to return any and all bid bonds held by City in con-
nection with said bids.
3. That bids shall be received for the construction of improve-
ments in East San Rafael Drainage Assessment District No. 2, City of
San Rafael, Marin County, California, on the 16th day of January, 1975
at 2:00 o'clock P.M. of said day. Said bids or proposals shall be
delivered on or before 2:00 o'clock P.M. on the 16th day of January,
1975 at the office of the City Clerk of the City of San Rafael, City
Hall, 1400 Fifth Avenue, San Rafael, California. Said bids, after
being publicly opened, examined and declared, will be calculated by
the Engineer of Work, his report returned to the City Clerk, and the
report of the results of the bidding and the calculations of the Engi-
neer of Work will be reported to the City Council of the City of San
Rafael. The City Council reserves the right to reject any and all
proposals or bids, should it deem this necessary for the public good,
and also the bid of any bidder who has been delinquent or unfaithful
in any former contract with the City of San Rafael.
4. The improvements herein referred to shall be in accordance
with plans and specifications heretofore adopted by the City Council
of the City of San Rafael.
5. The City Clerk of the City of San Rafael is hereby directed
to advertise for construction bids in the manner provided by law.
I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the City Council of the City of San Rafael, Marin
County, California, at a regular adjourned meeting thereof, held on the
19th day of December, 1974, by the following vote, to wit:
AYES: Councilmen Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini
NOES: Councilmen None
