A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized t.. execute, on behalf
of the City of San Rafael a lease or agreement with
San Rafael Fireman's Association Local 2208
A copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael, here-
by certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said
City held on Monday the 16th day of December ,
19 74 , by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini

AGREEMENT
The City of San Rafael, San Rafael Fireman's Association
Local 2208, and the fire fighters named below, agree as follows:
(1) All questions, including alleged violations relating to
the City of San Rafael, pertaining to the right to promotion of fire
fighters certified on the 1973-74 battalion chief's promotional list
and the battalion chief's vacancy which occurred in June 1974, shall
be submitted to attorney Armon Barsamian, 16 Esmeyer Drive, San Rafael,
California, for binding determination. No other forum shall be invoked
by any of the parties except to the extent necessary to enforce this
Agreement or Mr. Barsamian's Award. The hearing before Mr. Barsamian
shall occur as early as possible, and the costs of the proceeding, in-
cluding Mr. Barsamian's fees, the costs of a court reporter and related
expenses shall be borne equally by the City of San Rafael and San Rafael
Fireman's Association Local 2208. The hearing shall be closed to all
persons except the participants and other persons agreed to by the
parties.
(2) A battalion chief's promotional examination shall remain
open for application until Mr. Barsamian issues a final Award. The
battalion chief's examination which follows the Arbitration Award shall
be subject to conditions set forth in a letter from the City Manager
to the Fire Fighters Union.
