HomeMy WebLinkAboutCC Resolution 4704RESOLUTION NO. 4704 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL, MARIN COUNTY, STATE OF CALIFORNIA, FOR THE ADOPTION OF THE CONSERVATION AND OPEN SPACE ELEMENTS OF THE GENERAL PLAN. WHEREAS, Section 65302 of the Government Code specifies that the General Plan shall include a conservation element and an open space element; and, WHEREAS, the State of California Government Code requires that every City shall prepare, adopt and submit to the Secretary of the Resources Agency a local open - space plan for the comprehensive and long-range preservation and conservation of open space land within its jurisdiction; and, WHEREAS, Section 65560 of the Government Code specifies that the "local open - space plan is the open space element of a City general plan;" and WHEREAS, Section 65564 of the Government Code specifies that "Every local open space plan shall contain an action program consisting of specific programs which the legislative body intends to pursue in implementing its open space plan; and, WHEREAS, the City of San Rafael contracted in 1972 with consultants for the preparation of a new General Plan containing all elements required by State Law; received and distributed over 600 copies of a first draft of same on November 5, 1973 (Entitled "Initial General Plan") and another 600 copies of a second draft of same on January 10, 1974 (Entitled "Preliminary General Plan"); and WHEREAS, the San Rafael Planning Commission legally advertised in the Independent Journal on February 1, 1974, and otherwise gave notice of public hearings on the General Plan, -which hearings commenced at 7:30 p.m., in the City Council Chambers, City Hall, San Rafael, on February 13, 1974, and were continued from time to time (February 19, 25, 27, March 5, 7, 14, 19, 21) for the purpose of permitting further public input and Commission workshop sessions during the course of which revision was made to both the text and maps; and WHEREAS, the citizens of the City of San Rafael have indicated strong intention that effective action be taken to conserve and preserve key areas of natural resources and open space as demonstrated by their approval in 1972 by a 75% vote of a bond issue for $2,250,000 for funds with which to purchase land for the purpose of preserving it in its natural state; and WHEREAS, the City Council has recognized this as a first priority item and implemented same by issuing said bonds and by appointing a Citizens Advisory Committee on Open Space Selection to make recommendation on the areas to be so purchased; and WHEREAS, the City of San Rafael on May 21, 1973, adopted procedures for imple- menting the acceptance of open space easements or deeds for scenic restriction thereby augmenting the methodology for conserving open space; and WHEREAS, adopted conservation and open space elements of a General Plan are a necessary prerequi s i tes thereto; and WHEREAS, the Planning Commission has reviewed and revised these elements and other related elements of the General Plan to the point that it is satisfied that the conservation and open space elements are ready for adoption and will be con- sistent with other elements of the General Plan for which hearings still continue; and WHEREAS, the San Rafael Planning Commission favorably recommends to Council of the City of San Rafael for its adoption the Conservation Elements of the General Plan as set forth in text and map form and and made a part hereof; and t tA�. . R",u a•i the City and Open Space attached hereto WHEREAS, it is the intention of the City Council that if any amendments, additions or deletions to this Conservation and Open Space Element are necessary and desirable, said Conservation and Open Space Element may be amended to include those matters necessary and desirable at the time of the completion and adoption of the General Plan of the City of San Rafael. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael adopts the Conservation and Open Space Elements of the General Plan as set forth in text and map form and attached hereto and made a part hereof.
