RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING MAYOR AND CITY CLERK TO ENTER CONTRACT FOR
PURCHASE OF PROPERTY AND ACCEPTING DEED TO REAL PROPERTY
AND TEMPORARY CONSTRUCTION EASEMENT.
WHEREAS, the City of San Rafael is undertaking the improvement
of the west end of Fourth Street and Miracle Mile; and
WHEREAS, the acquisition of certain property is necessary to
accomplish said improvements; and
WHEREAS, there has been negotiated between the City of San Rafael
and Alfred A. and Caroline Nannizzi the purchase of certain real pro-
perty, a description of which is set forth as Parcel 1, on Exhibit A,
attached hereto and made a part hereof by reference; and
WHEREAS, it is necessary in the construction of the improvements
contemplated to work upon other property owned by Alfred A. and Caroline
Nannizzi; and
WHEREAS, there has been negotiated a temporary construction
easement for said property. A description of the property encompassed
by said temporary construction easement is set forth as Parcel 2,
on Exhibit A, attached hereto. Said temporary construction easement
shall run for a period of 24 months from the date of recordation
of said temporary construction easement and shall automatically ter-
minate at the expiration of said 24 month period; and
WHEREAS, the purchase of said property, together with the tem-
porary construction easement are necessary and proper.
NOW THEREFORE, BE IT RESOLVED as follows:
The Mayor and City Clerk of the City of San Rafael are hereby
authorized to enter into and sign the appropriate documents and con-
tracts necessary for the purchase of said property.

BE IT FURTHER RESOLVED that the City Council of the City of
San Rafael hereby accepts the deed from Alfred A. and Caroline
Nannizzi to Parcel 1 of Exhibit A, attached hereto, on behalf of
said City.
BE IT FURTHER RESOLVED that the City Council of the City of
San Rafael hereby accepts the deed for the temporary construction
easement from Alfred A. and Caroline Nannizzi to Parcel 2 of Exhibit
A, attached hereto, on behalf of said City.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby
certify that the foregoing Resolution was duly and regularly intro-
duced and adopted at a regular meeting of the Council of said City
held on the 6th day of May 1974, by the following vote,
to -wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini

EXHIBIT A
'PARCEL ONE:
That certain real property situated in the City of San Rafael, County of
Marin, State of California, and being a portion of that real property as
described in the Joint Tenancy Deed #13967 as recorded in Book 1120 of
Records at Page 265, more particularly described as follows:
COMMENCING at a point on the intersection of the Southerly line of Fourth
Street and the Westerly line of Ross Valley Drive (in the City of San
Rafael) thence North 780 02' West 153.34 feet; thence South 10 42' West
22.38 feet to a point on the Northerly line of the Northwestern Pacific
Railroad (now a public street) thence South 820 55' East 150.14 feet along
the said Northerly line of said railroad to a point on the Westerly line
of Ross Valley Drive; thence North 70 05' East 3.90 feet along said
Westerly line of Ross Valley Drive to the point of commencement, an area
of 1,969 square feet, more or less.
PARCEL TWO:
A Temporary Easement for the period of 24 months, commencing April 1, 1975
for the purpose of ingress, egress, construction and maintenance of a
detour over a triangular strip of land more particularly described as follows:
COMMENCING at the intersection of the Southerly line of Fourth Street and
the City Limit Line of the City of San Rafael and the City of San Anselmo,
thence South 10 42' West 22.38 feet along said City Limit Line to a point
on the Northerly Line of the Northwestern Pacific Railroad (now a public
street) thence North 820 55' West 100.00 feet along said Northerly line of
said railroad, thence North 840 15' 52" East 100.40 feet to the point of
commencement, an area of 1114 square feet, more or less.
