HomeMy WebLinkAboutResolution No. 4721RESOLUTION NO. 4721 RESOLUTION ACCEPTING GRANT OF LEVEE EASEMENT WHEREAS, public interest, convenience and welfare require that the levee easement hereinafter mentioned be accepted and used for the benefit of the public of the City of San Rafael, California; NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of San Rafael, California, that that certain grant of right-of-way for the maintenance, repair, reconstruction, renewal, and access to said levee, executed by DAISY S. KOCH to the City of San Rafael, dated MAY 24, 1974 , be and the same is hereby accepted and the Clerk of said City is hereby directed to cause said conveyance to be duly recorded in the office of the County Recorder of the County of Marin, State of California, forthwith upon the adoption of this resolution. I, MARION A. GRADY , Clerk of the City of San Rafael, California hereby certify that the foregoing resolution was duly and regularly intro- duced and adopted at REGULAR meeting of the Council of said City held on MONDAY the 3RD day of JUNE , 19 74 , by the following vote, to -wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None MARION A. KOCH (hereinafter called "Grantor" without regard to number or gender) for an adequate con- sideration hereby GRANTS and conveys to the CITY OF SAN RAFAEL, a munici- pal corporation, an EASEMENT over the strip of land hereinafter described for the purpose of installing, constructing, renewing, inspecting, main- taining, repairing and using a levee on or under said strip of land together with the right of ingress thereto and egress therefrom, in, on and across said strip of land and the contiguous real property of Grantor. Said strip of land is located in the City of San Rafael, County of Marin, State of California, and is more particularly described as follows: SEE ATTACHED DESCRIPTIONS Grantor shall not plant, place or -deposit anything in or on said strip of land which will damage or interfere with any of the rights granted hereunder nor shall Grantor erect or construct any building or other structure or drill or operate any well within said strip of land without the approval of the City. The provisions hereof shall inure to the benefit of and bind the heirs, successors, and assigns of the respective parties hereto. Being a portion of Lots E and F, Map of East San Rafael. TOGETHER with an access easement over the following des- cribed Parcel. Beginning at a point distant S 540421E 70.00 feet from the most Westerly corner of Lot E, as shown on that certain Map entitled "Map of East San Rafael, Marin County, California" filed for record January 21, 1908, in Volume 2 of Maps at Page 109, Marin County Records; running thence from said point of beginning N 350181E 95.0 feet, S 540421E 7.50 feet, S 35018'W 56.67 feet, S 54°42'E 2.50 feet, S 35018'W 38.33 feet, and N 54°42'W 10.00 feet to the point of beginning.
