A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as
fol lows :
The MAYOR and CITY CLERK are authorized to execute,
on behalf of the City of San Rafael a lease or agreement with
SAN RAFAEL SCHOOL DISTRICT ,
a copy of which is hereby attached and by this reference made a
part hereof. (JOINT POWERS AGREEMENT, DATED APRIL 23, 1974
FOR MUTUAL RESURFACING PROJECT)
I, MARION A. GRADY , Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a REGULAR meeting of the
Council of said City held on MONDAY the 3RD
day of JUNE 19_4, by the following vote, to -wit:

JOINT POWERS AGREEMENT
TIIIS AGREEMENT, entered into this 23rd
day of April ,
1974, by and between the CITY OF SAN RAFAEL, hereinafter referred to as
"City", and the SAN RAFAEL SCHOOL DISTRICT, hereinafter referred to -as
"District", for the fiscaa year 1974-75;
WITNESSETH:
WHEREAS, both City and District are authorized by law to make
necessary repairs to city streets and school property respectively; and
WHEREAS, District is desirous of having certain blacktopping work
done per Exhibit "A" attached hereto; and
WHEREAS, City is desirous of resurfacing those certain City streets
as shown on Exhibit "B" attached hereto; and
WHEREAS, it is mutually desirous that the work on both projects be
accomplished by the same contractor under a single contract.
NOW, THEREFORE, IT IS HEREBY AGREED by and between the parties
hereto as follows:
1. City shall prepare the bid documents for the completion of
the two projects, and shall administer the contract granted to the
successful bidder.
2. The City bid documents for Lhe resurfacing of those certain
City streets as shown on Exhibit "B" attached hereto, shall include
an alternate prcvision whereby the contractor shall complete the
necessary blacktopping as per Exhibit "A" attached hereto, pursuant to
the specifications provided City by District.
3. The contract between City and the suocessful bidder sha11
include the alternate for the District blacktopping work if the District
advises City that the bid is acceptable on that portion of the work.
4. It will be the responsibility of the District to provide any
necessary site preparation.
5. Upon the completion of the work. District shall pad• to City
the amount of the District's portion of the work.
6, District shall furnish one inspector for the duration of the work, who
will be responsible for insuring that the District portion of the work is in accordance
with plans and specifications.
IN WITNESS WHEREOF, the parties hereto have executed this Joint Powers
Agreement on the day and year first above written.
