RESOLUTION ACCEPTING GRANT OF PUBLIC ACCESS EASEMENT AND STORM DRAIN EASEMENT
WHEREAS, public interest, convenience and welfare require
that the easement hereinafter mentioned be accepted and used for the
benefit of the public of the City of San Rafael, California;
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council
of the City of San Rafael, California, that that certain grant of
right-of-way for public access and for the maintenance, repair, recon-
struction and renewal of public storm drain, executed by
TWENTIETH CENTURY BUILDERS. INC.
to the City of San Rafael, dated MAY 17, 1974 , be and the same
is hereby accepted and the Clerk of said City is hereby directed to
cause said conveyance to be duly recorded in the office of the County
Recorder of the County of Marin, State of California, forthwith upon the
adoption of this resolution.

GRANT OF EASEMENT FOR PUBLIC ACCESS AND
CONSTRUCTION AND MAINTENANCE OF STORM DRAIN
Twentieth Century Builders, Inc., a California corporation (hereinafter called
"Grantor" without regard to number or gender) for an adequate consideration hereby
GRANTS and conveys to the CITY OF SAN RAFAEL, a municipal corporation, an Easement over
the lands hereinafter described for the purpose of public access and for laying down,
installing, constructing, renewing, inspecting, maintaining, repairing and using a
public storm drain on or under said lands together with the right of ingress thereto
and egress therefrom, in, on and across said lands and the contiguous real property of
Grantor.
Said lands are located in the City of San Rafael, County of Marin, State of
California, and are more particularly described as follows:
PARCEL A (PUBLIC ACCESS)
A STRIP OF LAND with the uniform width of 5 feet lying Southeasterly of and
contiguous to the Northwesterly line of Lot 3, as shown upon that certain map
entitled, "Map of Oak Woodlands Unit One -B, San Rafael, California", filed for
record July 9, 1963 in Volume 11 of Maps, at Page 94, Marin County Records.
SAID STRIP to run for its' full width from Mountain View Avenue to the
Northeasterly line of said Lot.
PARCEL B (STORM DRAIN)
BEGINNING at the intersection of the Northwesterly lot line of Lot 3 and the
Southeasterly line of Mountain View Avenue, as said Lot and Avenue are shown
upon that certain map entitled, "Map of Oak Woodlands Unit One -B, San Rafael,
California", filed for record July 9, 1963 in Volume 11 of Maps, at Page 94,
Marin County Records; running thence from said point of beginning and along
said Avenue line on a curve to the right, which center bears South 76' 37' 36"
West 40 feet through a central angle of 080 35' 40" for an arc distance of
6.00 feet; thence leaving said line and running North 58° 45' 44" East 57.455
feet; thence North 480 40' East 68.00 feet to a point on the Northeasterly
line of said Lot 3; thence along said lot line, North 690 00' West 17.095 feet
to the Northerly corner thereof; running thence along the Northwesterly line,
South 48° 40' West 113.43 feet to the point of beginning.
Grantor shall not plant, place or deposit anything in or on said lands which will
damage or interfere with any of the rights granted hereunder nor shall Grantor erect
or construct any building or other structure or drill or operate any well within said lands.
The provisions hereof shall inure to the benefit of and bind the heirs, successors,
and assigns of the respective parties hereto.
