HomeMy WebLinkAboutResolution No. 4733RESOLUTION NO. 4733 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL CONSENTING TO THE COMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION OF CERTAIN INHABITED TERRITORY DESIGNATED AS "KNOCKNABOUL WAY ANNEXATION" WHEREAS, on the 2nd day of April, 1974, an application was filed with the Local Agency Formation Commission applying for annexation of certain inhabited territory therein referred to and generally described, which is contiguous to the City of San Rafael; and WHEREAS, the Local Agency Formation Commission by Resolution No. 74-17, approved on April 17, 1974; and WHEREAS, said application for annexation was referred to the Planning Commission of the City of San Rafael for investigation, report and recom- mendation; and WHEREAS, the Planning Commission rendered its report and recom- mendation to the council on the 14th day of May, 1974, favoring the com- mencement of annexation proceedings; and WHEREAS, it is the desire of the City Council to give its consent to the commencement of such annexation proceedings upon condition that the electors within said territory be informed at the time the petition for annexation is circulated that the question to be submitted to said electors shall be whether the territory shall be annexed, and the property in the territory subjected to taxation after annexation equally with the property within the City of San Rafael to pay the entire bonded indebtedness of the City of San Rafael outstanding or authorized at the date of the first publi- cation of the notice of election, for the acquisition, construction or com- pletion of municipal improvements, excepting therefrom the City of San Rafael General Obligation Sewer bonds, April 20, 1971, issue. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael: 1. That consent be and hereby is granted for the commencement of annexation proceedings in connection with said inhabited territory in accord- ance with the Annexation Act of 1913, provided the petition for annexation contains a request that the question to be submitted to the electors residing in the territory proposed to be annexed shall be whether the territory shall be annexed, and the property in the territory subject to taxation after an- nexation equally with property within the City of San Rafael to pay the bonded indebtedness of the City of San Rafael outstanding or authorized at the date of the first publication of the notice of election for the acquisition, con- struction or completion of municipal improvements, excepting therefrom the City of San Rafael General Obligation Sewer Bonds, April 20, 1971 issue. 2. That said unincorporated territory be and hereby is designated as "Knocknaboul Way Annexation" and is described in Exhibit A attached hereto. I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held on Monday the 3rd day of June 1974, by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None MARION A. GRADY - City Clerk - 2 - r BOUNDARY DESCRIPTION FOR KNOCKNABOUL WAY Beginning at a point on the existing San Rafael City limit line, said point being the most Northerly corner of Lot 60, as shown upon that certain map entitled, "Las Colindas Unit Three," recorded March 14, 1955 in Book 8 of Maps, at page 44, Marin County Records, thence leaving the present San Rafael City limit line and proceeding North 180 16° East 100.00 feet to a point on the present boundary of the San Rafael City limit, said point being the most Easterly corner of Lot 195, as shown upon that certain map entitled, "Las Colindas Unit Seven," recorded December 5, 1960 in Volume 10 of Maps, at page 91, Marin County Records; thence proceeding Northerly,..Westerly, Southerly and Easterly along the existing San Rafael City limit line to the point of beginning.'
