HomeMy WebLinkAboutResolution No. 47460 RESOLUTION NO. 4746 RESOLUTION SETTING TIME AND PLACE FOR HEARING FOR DETERMINING PUBLIC CONVENIENCE AND NECESSITY IN SANTA MARGARITA OPEN SPACE ASSESSi.��iT DISTRICT, CITY OF SAN RAFAEL, MARIN COUNTY, CALIFORNIA WHEREAS, the City Council of the City of San Rafael, Marin County, California, has adopted a map showing the boundaries of pro- posed Santa Margarita Open Space Assessment District, City of San Rafael, Marin County, California, which said map is entitled, "Proposed Boundaries of Santa Margarita Open Space Assessment District, City of San Rafael, County of Marin, California"; and WHEREAS, the owners of more than sixty per cent (600) of the real property within the boundaries of said proposed assessment district have waived all investigation proceedings under the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 and have requested that said act shall not be applicable to these proceedings; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael, Marin County, California, as follows: 1. That Mondav, the lst day of July, 1974, at the hour of 8:00 o'clock P.M. of said day, is hereby fixed as the day and hour, and the meeting place of the City Council of the City of San Rafael, located in the Council Chambers, 1400 Fifth Avenue, San Rafael, California, as the place, when and where any and all persons interested may appear and show cause why the City Council of the City of San Rafael should not find and determine that the public convenience and necessity require the said proposed acquisition of real property to be made in said proposed assessment district, without compliance with the provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931. 2. The time and place of hearing shall be given in accordance with the provisions of Ordinance No. 590 of the City Council of the -I- City of San Rafael. In addition, the City Clerk of the City of San Rafael is hereby authorized and directed to cause a Notice of Hearing to be mailed to each of the owners of property located within the boundaries of said assessment district. I HEREBY CERTIFY that the foregoing Resolution was duly and regularly adopted by the City Council of the City of San Rafael, Marin County, California, at a regular meeting thereof, held on the 17th day of June, 1974, by the following vote, to wit: AYES: Councilmen: Jensen, Miskimen, Nixon and Mayor Bettini NOES: Councilmen: None ABSENT: Councilmen: Mwl cyan MARION A.
