HomeMy WebLinkAboutResolution No. 4781RESOLUTION NO. 4781 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DECLARING ITS INTENTION TO CALL A SPECIAL ANNEXATION ELECTION, AND FIXING A TIME AND PLACE FOR PROTESTS BY PROPERTY OWNERS. WHEREAS, on the 9th day of J u 1 Y , 1974, a petition proposing that new territory, hereinafter described, be annexed to the City of San Rafael was duly received by the City Council; and WHEREAS, said petition is signed by not less than one-fourth of the qualified electors residing within said described territory as shown by the county registration of voters; contains said description of the new territory and asks that said described new territory be annexed to the City of San Rafael. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael as follows: 1. That its is the intention of the City Council of the City of San Rafael to call a special election to be held in certain inhabited territory contiguous to said City, proposed to be annexed thereto, for the purpose of submitting to the qualified electors residing in said territory the question whether or not said territory shall be annexed to the City of San Rafael, and the property in the territory subjected to taxation after annexation equally with property within the City of San Rafael to pay the bonded indebtedness of the City of San Rafael outstanding or authorized, at the date of the first publication of the notice of election, for the acquisition, construction or completion of municipal improvements, with the exception of 1971 General Obligation Bonds for Sewers. Said territory is described in Exhibit "A" attached hereto. 2. That said territory hereby is designated and identified as 'knock- naboul Way Annexation"and shall be so designated and referred to upon the election ballots. 3. Notice hereby is given that on the 5th day of August, 1974, at the hour of 8:00 p.m., in the Council Chamber of the City Hall of the City of San Rafael, any person owning real property within said territory so pro- posed to be annexed and having any objection to the proposed annexation may appear before said City Council concerning written protest against the annexation filed pursuant to the law for filing such pro -tests. Such protests must be in writing, must be filed at any time not later than the hour set for hearing objections to the election and show' the name or names of the owner or owners of the property affected by such annexation and the street address or other description of the property sufficient to identify it on the last equalized assessment roll. Protests may be made by petition, forms for which are available upon request at the office of the City Clerk. If it be found that protest is not made by public and private owners equal to one-half of the value of the territory further proceedings shall be taken in accordance with the law for the holding of such special election. 4. That the City Clerk shall certify to the adoption of this resolution and cause the same to be published in the Independent Journal once a week for two successive weeks prior to the hearing. I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held on Monday the 15th day of July, 1974, by the following vote, to wit: AYES: COUNCILMEN: Jensen, Mulryan, Nixon and Acting Mayor Miskimen NOES: - COUNCILMEN: None ABSENT: COUNCILMEN: Mayor Bettini MARION A. BOUNDARY DESCRIPTION FOR KNOCKNABOUL WAY Beginning at a point on the existing San Rafael City limit line, said point being the most Northerly corner of Lot 60, as shown upon that certain map entitled, "Las Colindas Unit Three," recorded March 14, 1955 in Book 8 of Maps, at page 44, Marin County Records, thence leaving the present San Rafael City limit line and proceeding North 180 16' East 100.00 feet to a point on the present boundary of the San Rafael City limit, said point being the most Easterly corner of Lot 195, as shown upon that certain map entitled, "Las Colindas Unit Seven," recorded December 5, 1960 in Volume 10 of Maps, at page 91, Marin County Records; thence proceeding Northerly, Westerly, Southerly and Easterly along the existing San Rafael City limit line to the point of beginning. This parcel contains approximately 9.5 acres.
