HomeMy WebLinkAboutCC Resolution 4815 (Emergency Employment Act; COM)RESOLUTION NO. 4815 A RESOLUTION AUTHORIZING THE SIGNING OF A LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a lease or agreement with County of Marin for Funding of Emergency Employment Act A copy of which is hereby attached and by this reference mads a part hereof. I, MARION A. GRADY, City Clerk of the City of San Rafael, here- by certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held on Monday the 19th day of August , 19__Z4 , by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Nixon MARION A. GRADY - City Clerk oRiroN�.l r AGREEMENT THIS AGREEMENT made and entered into this _ day of , 1974, by and between the County of Marin, hereinafter referred to as "County", and City of San Rafael hereinafter referred to as "Sut,-grantee"; W I T N E S S E T H: IN CONSIDERATION of the mutual promises and covenants hereinafter contained, the parties hereto do hereby agree as follows: 1. County agrees to provide those certain services required of it as Prime Sponsor under Public Law 93-203 (Comprehensive Employment and Training Act of 1973, Title II) for the benefit of City of San Rafael 2. City of San Rafael agrees to abide by the terms and condition contained in Public Law 93-203 in the operation of this program. 3. It is understood between the parties hereto that this Agreement is subject to the regulations and conditions governing grants in the CETA, Title II, and any conflict between this Agreement and said regulations and conditions governing grants in the CETA, Title 11 shall be resolved in favor of said regulations and conditions governing grants in the CETA, Title II. 4. Records maintained by the Sub -grantee herein shall be maintained in the manner prescribed in the regulations and other instructions of the Department of Labor; and shall be available for audit by officials of County and the United States Government. 5. It is understood by the parties hereto that this Sub -grant does not become effective and operative until the agreement between County and the United States Government becomes effective, and shall be coextensive with said federal grant. 1 A 7V — -,-) - ell, ,,l�&_7 /n e/ arc �✓ c�.-�-7 CSC c..� •7 �-+-/ 6. There matching requirement for tF-irticipant's wage and fringe costs. However, should compensation to any participant funded from CETA, Title II federal funds exceed the maximum f -..:ll -time rate of $10,000 per year plus the cost of fringe benefits to the extent they exceed those paid to workers earning $10,000 a year, the Sub -grantee agrees to pay such excess in wage and fringe costs in cash. 7. Powers not explicitly vested in the Sub -grantee shall remain with the Prime Sponsor. 8. This Agreement may be modified if the U;�ited States Government ' modifies the grant to the Prime Sponsor in such a way -hat this grant is effected. 9. Sub -grantee hereunder agrees to reimbur•e the Government of the United States and/or the County of Marin for any f;nds found hereunder to be misspent. 10. It is understood that while the Sub-gra:,tee shall not be required to retain its participant beyond the termination of the grant period, it shall make every reasonable effort to fulfill the g -al of placing half of the participants in a suitable occupation by such time IN WITNESS WHEREOF the parties hereto have et their hand the date and year above written.
