RESOLUTION REMOVING A SIXTY FOUR (64) FOOT LENGTH OF
A TWO HUNDRED AND FORTY (240) FOOT LONG, ONE (1) FOOT
NON -ACCESS STRIP, FROM THE WESTERLY SIDE OF ELDA DRIVE
ADJACENT TO THE LANDS OF FREITAS AND BEGINNING AT THE
MOST EASTERLY CORNER OF LOT 61, SAID POINT BEING THE
POINT OF TANGENCY OF A 20' RADIUS CURVE AND THE WESTERLY
RIGHT OF WAY LINE OF ELDA DRIVE AND TERMINATING S 70 20' E
SIXTY FOUR (64) FEET THEREFROM AS SHOWN ON THE RECORD SUB-
DIVISION MAP OF "TERRA LINDA UNIT 20"
WHEREAS, the San Rafael Planning Commission and City Council have here-
tofore approved the subdivision map of "Terra Linda Unit 20";
AND WHEREAS, said subdivision map of "Terra Linda Unit 20" was recorded
on September 26, 1963, in Vol. 12 of Maps at Page 32, Marin County Records;
AND WHEREAS, the Record Subdivision Map of "Terra Linda Unit 20" in
the City of San Rafael, shows a one (1) foot non -access strip two hundred
and forty (240) feet in length along the westerly side of Elda Drive adjacent
to the lands of Freitas, beginning at the northeast corner of Lot 60 and
terminating at the most easterly corner of Lot 61;
AND WHEREAS, Harold Holtzinger has requested that a sixty four (64)
foot length of the said two hundred and forty (240) foot long, one (1) foot
non -access strip be removed from the westerly side of Elda Drive to provide
access to adjacent parcel of land;
AND WHEREAS, the San Rafael Planning Commission, on August 8, 1974,
under Item P 74-8, recommended the removal of said (1) foot non -access
strip;
NOW, THEREFORE, BE IT RESOLVED that a sixty four (64) foot length of
a two hundred and forty (240) foot long, one (1) foot non -access strip,
from the westerly side of Elda Drive adjacent to the lands of Freitas and
beginning at the most easterly corner of Lot 61, said point being the point
of tangency of a 20" radius curve and the westerly right of way line of
Elda Drive and terminating S 7° 20' E, sixty four (64) feet therefrom as
shown on the Record Subdivision Map of "Terra Linda Unit 20" be and the
same is hereby removed.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify
that the foregoing resolution was duly and regularly introduced and adopted
at a - regular meeting of the Council of said City on the 19th day
of August 1974, by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Nixon
