HomeMy WebLinkAboutCC Resolution 4840 (Senior Citizen Programs)RESOLUTION NO. 4840 A RESOLUTION AUTHORIZING THE SIGNING OF A LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a lease Dr agreement with the County of Marin (for joint funding of Senior Citizens programs i n San Rafael) A copy of which is hereby attached and by this reference made a part hereof. I, MARION A. GRADY, City Clerk of the City of San Rafael, here- by certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held on Monday the 16th day of September , 1974, by the following vote, to wit: AYES: COUNCILMEN: Miskimen, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Jensen and Mulryan MARION A. GRADY - City CletX JOINT POWERS AGREEMENT For Providing of Recreational Program for Senior Citizens. THIS AGREEMENT, made and entered into this day of , 19743 by and between the COUNTY OF MARIN, a political subdivision of the State of California, hereinafter referred to as "County," and City of San Pafael , hereinafter referred to as "City," W I T N E S S E T H: In consideration of the mutual promises and covenants hereinafter contained, the parties hereto do hereby agree as follows: 1. City shall provide the facilities, supplies and staff to pro- vide a recreational program for all senior citizens of the County of Marin regardless of their place of residence in said County in accordance with the detailed recreational plans contained in "Exhibit All (A = Budget) and "Exhi•- bit B" (B = Activity Plan). Attached hereto and incorporated herein, said detailed recreational plan hereinafter being referred to as "Program." 2. The implementation of said program shall be as City shall de- termine. Parties hereto agree that this Agreement shall not be construed as creating employment or agency relationship, but that City is an independent contractor. In this connection, all personnel staffing the programs enum- erated herein shall be employees of City or its delegate agency. It is understood and agreed that County shall have no direct control of or respon- sibility for employees of City or its delegate agencies. 3. County agrees to nay City, in consideration of Cities operation of the aforesaid program, the sum of $12,000.00 , said sum to be pn-tr- able on demand as follows, subject to timely receipt of required reports: Within 10 days of execution November 1, 1974 February 3., 1975 May 1, 1975 $3.000.00 3,000.00 3,000.00 3,000.00 Request for funds must be accompanied by a quarterly financial report. 4. City shall expend the funds as specified in Exhibit A and PI -11 submit quarterly financial reports showing expenditures of the funds payable hereunder on behalf of the various programs to County. This Agreement shall continue from July 1, 1974 to June 30, - 2 - 1975s provided, however, that either party hereto may terminate this Agree- ment by giving the other thirty (30) days' written notice. In the event of such termination, then County's obligation to City hereunder shall terminate forthwith. Insofar as this Agreement is concerned, City will no longer be obligated to operate said programs, provided, however, th?t the reports and audits provided for in Sections 4, 5 and 6 hereof still are recuired to be performed and that the provisions of Section 7 will still apply for the period this Agreement is in force.
