RESOLUTION OF INTENTION TO MAKE CHANGES IN THE COST OF
THE WORK AND SETTING TIME AND PLACE OF PUBLIC HEARING
THEREON, EAST SAN RAFAEL DRAINAGE ASSESSMENT DISTRICT
NO.. 2, CITY OF SAN RAFAEL, MARIN COUNTY, CALIFORNIA
WHEREAS, on the 18th day of June, 1973, the City Council of
the City of San Rafael, Marin County, California, adopted its
Resolution of Intention for the improvements and acquisitions in
East San Rafael Drainage Assessment District No. 2, City of San
Rafael, Marin County, California, as amended, and referred said
improvements and acquisitions to ELY CAILLOUETTE, Jr., Engineer
of Work for said assessment district; and
WHEREAS, said City Council directed that said Engineer of
Work make and file with the City Clerk of the City of San Rafael
a report in writing in accordance with the provisions and require-
ments of the Municipal Improvement Act of 1913 of the State of
California; and
WHEREAS, said Engineer of Work did, on the 4th day of
February, 1974, file with the City Clerk of the City of San Rafael
a report in accordance -with the said resolution; and
WHEREAS, said City Council did, on the 4th day of February,
1974, preliminarily adopt said report and called for public bids for
doing of the work to be submitted to the City Clerk on March 4,
1974; and
WHEREAS, bids were received on said date which bids were
in excess of the Engineer's Estimate of Cost of the work; and
WHEREAS, the property owners requested that the construction
of the levee be deleted from the project; and
WHEREAS, said Engineer of Work did, on the 5th day of August,
1974, file with the City Clerk of the City of San Rafael an Amended
Engineer's Report and said City Council called for public bids for
the doing of the work without the levee to be submitted to the
City Clerk on the 19th day of September, 1974; and

WHEREAS, bids were received on said date which bids were in
excess of the Amended Engineer's Estimate of Cost of the work; and
WHEREAS, on the 7th day of October, 1974, said Engineer of
Work filed a Second Amended Engineer's Report setting forth increased
costs of the work to be done, an increase in the total assessment to
be levied, and an increase in individual assessments to be levied as
a result of said increased costs;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of San Rafael, Marin County, California, and this Council hereby finds:
1. That the Second Amended Engineer's Report made and filed
by the Engineer of Work on the 7th day of October, 1974, sets forth
the increased cost of doing the work, the increase in the total
amount of the assessment to be levied, and the increase in the amount
of individual assessments to be levied.
BE IT FURTHER RESOLVED that Monday, the 4th day of November,
1974, at the hour of 8:00 o'clock P.M. of said day, at the meeting
place of the City Council of the City of San Rafael, located at
1400 Fifth Avenue, San Rafael, California, is hereby fixed as the
time and place for hearing protests with relation to the proposed
increase in total assessment to be levied and the increase in the
individual assessments to be levied; that any person interested in
objecting to said increases may file protest in writing with the
City Clerk of the City of San Rafael at or before the hour fixed
herein for hearing thereon; and
BE IT FURTHER RESOLVED that the City Clerk of the City of San
Rafael be, and she is hereby, directed to publish this resolution
pursuant to Section 6061 of the Government Code of the State of
California, said resolution to be published at least ten (10) days
prior to the date herein set for hearing of protests; and
BE IT FURTHER RESOLVED that said resolution of the proposed
increased assessment shall be mailed, postage prepaid, to all

persons owning real property to be assessed whose names and addresses
appear upon the last equalized assessment roll for taxes, or as
known to the City Clerk, said notices to be mailed at least twenty
(20) days prior to the date herein set for hearing of protests; and
BE IT FURTHER RESOLVED that it is the finding of the City
Council that these proceedings or changes in the cost of the work
and assessments are being taken in accordance with the provisions
of Chapter 4.5, Division 12 of the Streets and Highways Code of
the State of California.
I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the City Council of the City of San Rafael,
Marin County, California, at a regular meeting thereof held on the
7th day of October, 1974, by the following vote, to wit:
AYES: Councilmen Jensen, Miskimen & Mulryan
NOES: Councilmen
ABSENT: Councilmen Nixon & Mayor Bettini
