RESOLUTION REMOVING A ONE FOOT NON -ACCESS STRIP, 155.25
FEET IN LENGTH, FROM THE NORTHERLY END OF MOUNTAIN VIEW
AVENUE ADJACENT TO THE LANDS OF SPILIOTIS AS SHOWN ON THE
RECORD SUBDIVISION MAP OF "OAK WOODLANDS UNIT ONE -B"
WHEREAS, the San Rafael Planning Commission and City Council
have heretofore approved the subdivision map of "Oak Woodlands Unit One -B";
AND WHEREAS, said subdivision map of "Oak Woodlands Unit One -B"
was recorded on July 9, 1963, in Vol. 11 of Maps at Page 94, Marin County
Records;
AND WHEREAS, the Record Subdivision Map of "Oak Woodlands Unit
One -B" in the City of San Rafael, shows a one foot non -access strip 155.25
feet in length along the northerly end of Mountain View Avenue adjacent to
the lands of Spiliotis.
AND WHEREAS, Fidelity Savings and Loan Association has requested
that said one foot non access strip 155.25 feet in length, be removed from
the northerly end of Mountain View Avenue to provide access to adjacent
parcel of land;
AND WHEREAS, the San Rafael Planning Commission, on May 28, 1974,
under Item P 74-11, recommended the removal of said one foot non -access strip;
NOW, THEREFORE, BE IT RESOLVED that that certain one foot non -access
strip 155.25 feet in length, along the northerly end of Mountain View Avenue
adjacent to the lands of Spiliotis as shown on the Recorded Subdivision Map
of "Oak Woodlands Unit One -B" be and the same is hereby removed.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify
that the foregoing resolution was duly and regularly introduced and adopted
at a regular meeting of the Council of said City on the 7TH
day of OCTOBER , 1974, by the following vote, to wit:
AYES: COUNCILMEN: Miskimen, Mulryan, Nixon and Mayor Bettini
NOES: COUNCILMEN: None
ABSTAIN: COUNCILMEN: Jensen
ABSENT: COUNCILMEN: None
