This delay has been requested by your City Attorney's office to allow time to obtain an acknowledgment from Cal PERS and the Marin County Employees Retirement Association that the First Amendment will not cause any adverse impact on either agency's respective retirement plan. In view of Chief Roach's imminent retirement, however, Marinwood's Fire Department will need to arrange for temporary Fire Chief Officer services until the First Amendment may be executed. Therefore, we are writing pursuant to Section 4{B) of the 2014 Agreement, to request that as of November 1, 2018 you temporarily assign appropriate San Rafael Fire Department personnel to provide standard Fire Chief Officer services to the Marinwood Fire Department until the First Amendment is ratified or April 30, 2019, whichever occurs first. 1 During this period, the terms of the 2014 Agreement would govern the relationship between the District's Fire Department and the City's Fire Department. Section 4(0) of the 2014 Agreement states that "[e]ach agency will maintain its existing separate budget; provided, however that the DISTRICT Fire Chief and the CITY Fire Chief shall work together to facilitate the efficient and equitable allocation of revenues and costs" for such temporary personnel assignments. We believe this provision will allow the District to reimburse the City for the cost of providing the additional requested temporary chief officer services. Therefore, we propose the following: if and when the First Amendment is approved for final execution by the parties, the First Amendment will reflect that it covers services provided by San Rafael as of November 1, 2018, so that those services will be compensated as part of the first year's compensation provided in the First Amendment. However, if for some reason the parties are unable to fully execute the First Amendment on or before April 30, 2019, the District will compensate the City of San Rafael for the temporary Fire Chief Officer services provided during that time at the rate $8,026 per month. If you are agreeable to this request as outlined above, please sign the enclosed copy of this letter where indicated below and return it to the undersigned prior to the close of business on October 31, 2018.
