CONSENT CALENDAR Member Thayer moved and Member Cohen seconded, to approve the recommended action on the following Consent Calendar items: ITEM RECOMMENDED ACTION 1. Approval of Minutes of Special Joint Meeting Approved as submitted. of October 18, 1993 and Regular Meeting of December 6, 1993 (AS) 2. Unapproved Minutes of the Citizen's Advisory Accepted report. Committee Meeting of December 2, 1993 (RA) - File R-140 IVB 4. Confirmation of Appointment of Chairman and Vice Confirmed Albert J. Boro as San Rafael Redevelopment Agency (AS) - File Chairman and Joan Thayer as Vice R-58 Chairman AYES: MEMBERS: Cohen, Heller, Thayer, Zappetini & Chairman Boro NOES: MEMBERS: None ABSENT: MEMBERS: None ABSTAINED: MEMBERS: Heller and Zappetini (from Minutes of 10/18/93 only - newly elected as of 11/9/93) The following item was removed from the Consent Calendar for discussion: 3. REPORT ON BID OPENING AND ADOPTION OF RESOLUTION REJECTING ALL BIDS - BRET HARTE STORM DRAIN CONDITION SURVEY (PW) - File (SRCC) 4-1-464 x R-140 Member Heller asked for an explanation of the bid process. Assistant Executive Director (Public Works) David Bernardi explained that when bids are called for, the law requires we advertise twice, once 14 days before bids are opened. The two notices cannot be closer than 10 days apart. Bids are all opened publically. Once they are opened the bids are evaluated to see if the bid bond is there, if they are a licensed contractor, etc. Then they are brought to the Council or the Agency for award of contract. Mr. Bernardi explained that in this particular case, one of the contractors submitted a bid for the project, but said he was only going to pay pervailing wages for the lowest laborer. Therefore, that bid could not be accepted. The other bid was excessive, beyond what the job was worth. A third bid was received 19 minutes late. So, none of the bids qualified. On this particular job, the plan is to re -advertise in the spring or early summer and hopefully get some better prices. Member Heller moved and Member Thayer seconded, to accept the report on the bid opening and adopt Resolution. RESOLUTION NO. 93-33 - RESOLUTION REJECTING ALL BIDS FOR BRET HARTE STORM DRAIN CONDITION SURVEY AND AUTHORIZATION TO RE -ADVERTISE AND RE- BID PROJECT. AYES: MEMBERS:Cohen, Heller, Thayer, Zappetini and Chairman Boro NOES: MEMBERS:None ABSENT: MEMBERS: None 5. ANNUAL AUDIT AND ANNUAL REPORT FOR SAN RAFAEL REDEVELOPMENT AGENCY (RA) - File R-62 R-103 x (SRCC) 140 x 8-3 Jake Ours, Assistant Executive Director, presented the Annual Audit and Annual Report. He noted the Auditor has reviewed the books and found them to be in order. Member Thayer asked when do we renegotiate our Redevelopment III with the County? Chairman Boro indicated that he had recently talked with the Chairman of the Board of Supervisors who indicated it would be soon. Member Thayer moved and Member Cohen seconded, to approve the annual report and audit and forwarded them to City Council for review and approval. PRESENTATION BY CHAMBER OF COMMERCE OF ITS NOVEMBER, 1993 BUSINESS SURVEY (RA) - File R-103 Elissa Giambastiani, Executive Director of the San Rafael Chamber of Commerce, pre- sented a recent survey given to San Rafael businesses. She noted they were asked to rank those issues that were the most important impact to their success. They named things like Cost of Space, Labor Availability, Availability of Space, Government Regulations. The survey also tried to pinpoint any businesses that were planning to move in the near future. There were 18 planning to relocate, 11 of which indicated they might move out of the City. She stated that she and Mayor Boro are visiting those businesses. Most businesses feel that quality of life is the most important reason for staying in this area. Availability of affordable housing for employees was also an important item. She reported that she and Mayor Boro have been getting an excellent reception from the businesses they have called on. Ms. Giambastiani stated she will have assistance from the California Trade and Commerce Agency who is concerned about companies leaving California. A new Meeting and Planning Guide brochure has been developed and was distributed to the Agency members, paid for by the properties; no City funds were used. Member Thayer asked what were the local government restrictions that businesses were concerned about. Ms. Giambastiani answered that they are mainly talking about per- mitting, zoning. Chairman Boro stated that they had asked both of the companies they have visited with so far if they had any specific problems with the City of San Rafael. There were no recent problems that either mentioned; in fact, they have been very supportive of the City. Ms. Giambastiani thanked the Chairman and Agency Members for their interest and cooperation with this project. There being no further business, the meeting was adjourned at 8:00 PM. JEANNE M.
