HomeMy WebLinkAboutCC Resolution 4078RESOLUTION NO. 4078 RESOLUTION ACCEPTING GRANT OF SEWER EASEMENT WHEREAS, public interest, convenience, and welfare require that the easement hereinafter mentioned be accepted and used for the benefit of the public of the City of San Rafael, California; NOW THEREFORE, be it hereby resolved by the City Council of the City of San Rafael, California, that that certain grant of right-of-way for the mainten- ance, repair, reconstruction and renewal of the public sanitary sewer, executed by pacific Gas and Electric Company to the City of San Rafael, dated July 8, 1971 , be, and the same is hereby accepted and the Clerk of said City is hereby directed to cause said conveyance to be duly recorded in the office of the County Recorder of the County of Marin, State of California, forthwith upon the adoption of this resolution. I, MARION A. Grantor also grants to Grantee the right, of ingress to and egress from said strip of land, in, on, and across said strip, of land and the contiguous real property of Grantor. Grantor reserves the right to operate, maintain, use, reconstruct, replace and relocate its existing line of poles within said strip of land. Grantor shall not plant, place or deposit anything in or on said strip of land which will damage or interfere with any of the rights granted hereunder nor shall Grantor erect or construct any building or other structure or drill or operate any well within said strip of land other than as provided, for the afore- said line of poles. Grantee shall construct and maintain its sanitary sewer within said strip of land so as not to reduce the vertical clearance between Grantor's existing electric transmission lines and the ground thereunder below the minimum require- ments set forth in General Order No. 95 of the Public Utilities Commission of the State of California. The provisions hereof shall inure to the benefit of and bind the successors, and assigns of the respective parties hereto.
