HomeMy WebLinkAboutCC Resolution 4093RESOLUTION NO. 4093 RESOLUTION OF INTENTION TO VACATE VARIOUS EASEMENTS WHEREAS, it appears that the easements hereinafter described are unnecessary for present or prospective public use; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the City Council of the City of San Rafael, California, hereby elects to proceed under the PUBLIC SERVICE EASEMENTS VACATION LAW of the State of California; 2. That the City Council of the City of San Rafael, California, hereby declares its intention to close, vacate and abandon the easements hereinafter described; 3. That Monday, the 20th day of September , lg 71 , at 8:00 o'clock P.M., in the Council Chambers at the City Hall in the City of San Rafael, California, is hereby set as the time and place for hearing all persons interested in the proposed closing, abandoning and vacation of said easements; 4. That the Department of Public Works of the City of San Rafael shall post conspicuously notices of easement vacation along the line of the said easements proposed to be closed, abandoned and vacated, which notices shall be posted not more than three hundred feet apart but at least three notices shall be posted as to each such easement proposed to be closed, abandoned and vacated. The said notice shall state the time and place of the hearing, as hereinabove provided, and the adoption of the within resolution of intention; 5. That said easement proposed to be closed, abandoned and vacated are described on Exhibit "A", which is attached hereto and incorporated herein by reference; 6. That a map or plan showing said easements proposed to be closed, abandoned and vacated, is on file in the office of the City Clerk of the City of San Rafael at the City Hall, San Rafael, California. I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular _ meeting of the Council of said City on Monday, the 16th day of August 19 71 , by the following vote, to -wit: AYES: COUNCILMEN: Barbier, .Jensen, Miskimen, Mulryan and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None MARION A. Yard) EXHIBIT A Beginning at a point on the southerly line of Second Street, distant thereon seven (7) feet west of the northwest corner of that tract of land which was conveyed by John W. Mackay and others to the City of San Rafael, by a deed dated October 26, 1898, and recorded in the office of the County Recorder of Marin County, in Book 53 of deeds at Page 282; thence South 11° 05' West 698 6/10 feet along a levee, parallel with and seven feet west of the westerly line of said tract of land to the small levee on the north side of the Tidal Canal; thence along said small levee on the arc of a circle the chords thereof being as follows; South 77° 20' West 100 feet; North 890 10' West 100 feet and North 75° 40'*West 100 feet; thence leaving said small levee and crossing said Tidal Canal, South 54° 09' West 152 feet to a point in the southerly line of the right-of-way of the San Rafael and San Quentin Railroad. Said sewer easement being the same easement as conveyed by ,lames. L. Flood et ux, to the City of San Rafael by deed dated October 5, 1909 and recorded March 7, 1912 in Book 142 of Deeds at Page 179, Marin County Records.
