RESOLUTION ACCEPTING GRANT OF SEWER EASEMENT
WHEREAS, public interest, convenience, and welfare require that the easement
hereinafter mentioned be accepted and used for the benefit of the public of
the City of San Rafael, California;
NOW THEREFORE, be it hereby resolved by the City Council of the City of San
Rafael, California, that that certain grant of right-of-way for the mainten-
ance, repair, reconstruction and renewal of the public sanitary sewer,
executed by P. J. TARRANT CONSTRUCTION CO., TNC.
to the City of San Rafael, dated February 18, 1972
be, and the same is hereby accepted and the Clerk of said City is hereby
directed to cause said conveyance to be duly recorded in the office of the
County Recorder of the County of Marin, State of California, forthwith upon
the adoption of this resolution.

certify that the foregoing resolution was duly and regularly introduced and
adopted.at a regular adjourned meeting of the Council of said City held
on Monday, the 28th day of February. 1972 ,

GRANT OF EASEMENT FOR CONSTRUCTION
AND MAINTENANCE OF SANITARY SEWER
P. J. TARRA14T CONSTRUCTION CO., INC. (hereinafter
called "Grantor" without regard to number or gender) for an adequate consideration
hereby GRANTS and conveys to the CITY OF SAN RAFAEL, a municipal corporation, an
EASEMENT over the strip of land hereinafter described for the purpose of laying
down, installing, constructing, renewing, inspecting, maintaining, repairing and
using a public sanitary sewer on or under said strip of land together with the
right of ingress thereto and egress therefrom, in, on and across said strip of
land and the contiguous real property of Grantor.
Said strip of land is located in the City of San Rafael, County of Marin,
State of California, and is more particularly described as follows:
A Sewer Easement 10 feet in width, lying Southerly of, parallel with
and contiguous to the following described line: CPvlMENCING at a point
on the Westerly lire of Lincoln Avenue distant thereon 115 feet South-
erly from the Southeasterly corner of that certain lot conveyed by the
San Francisco Theological Seminary to Thomas P. Boyd, by a Deed dated
October 6, 1905 and recorded in Liber 96 of Deeds at page 26, Marin
County Records, as said lot is shown on that certain map entitled, "Map
No. 1 of a portion of the Coleman Tract, San Rafael, Marin County, Cal.",
recorded in Liber A of Miscellaneous at page 110, Marin County Records,
said point being also the Northeasterly corner of that certain parcel
of land conveyed to P. J. Tarrant Construction Co. Inc., a corporation
by deed recorded September 14, 1971 in Book 2501 of Official Records at
page 608; thence along the Northerly line of said Tarrant parcel South
70 23' 20" West (called South 700 45' West in said deed) 105 feet to
the point of termination of said easement:
operate any well within said strip of land.
The provisions hereof shall inure to the benefit of and bind the heirs,
successors, and assigns of the respective parties hereto.
