RESOLUTION NO.
RESOLUTION OF AWARD OF CONTRA -CT
WHEREAS, on the 14th day of January , 1972, pursuant to.due
and legal notice published in the manner provided by law, inviting sealed bids
or proposals for the work hereinto mentioned, as more fully appears from the
affidavit of publication thereof on file in the Office of the City Clerk of the
City of can Rafael, California, the City Clerk did publicly open, examine, and
declare all sealed bids or proposals for doing the following work in said City,
to -wit:
PROJECT NO. WS -Calif -358
SAAiITARY SEWER RECONSTRUCTION PROJECT - PHASE II
in accordance ivith the plans and specifications therefor on file in the Office
of said Cita Clerk; and
WHEREAS, the bid of KIRKWOOD-BLY, INC. at the prices stated in its bid
was and is the lowest and best bid for said work and said bidder is the lowest
responsible bidder therefor; and
WHEREAS, the award of contract is subject to KIRKWOOD-BLY, INC. compl.v= ng
with all the requirements of the U.S. Department of Housing and Urbani Development
as said requirements apply to the contract for the duration of the project; and
WHEREAS, said award of contract is further contingent to KIRi..W00D.-1,I:', I ;C.
performing the work under the cop -tract in such a manner so as to in no way
jeopardize the sewer grant funds available to the City from the U.S. Department
of Bousin,- and Urban Development for said project;
NOT41 THEREFORE, IT IS HEREBY ORDERED AND RESOLVED that the bid of
KIRKWOOD-BLY. INC.
be and the same is hereby accepted at said prices and that the contract for said
work and improvements be and the same is hereby awarded to said
KIRKW00D-ELY. INC.
at the price mentioned in said bid and subject to the above stated conditions;
IT IS FUY.ThER ORDERED AY cFSCLVED that the Mayor and the City Clem- of
said City be authorized and directed to execute a contract with
KIRKWOOD- BLY , INC.
for said work and to return the biddors bond upon the execution of said contract.
I, 14ARION A. GRADY, Clerk of the City of San Rafael, hereby certify that
the foregoing Resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City held on Monday the 20th
day of March 1972, by the following vote, to -wit:
AYES: COUNCILMEN : Barbier, Jensen, Miskimen, Mulryan and Mayor Bettini
NOES: COUNCILMEN : None
