HomeMy WebLinkAboutCC Resolution 4172RESOLUTION NO. 4172 RESOLUTION OF INTENTION TO VACATE VARIOUS EASEMENTS WHEREAS, it appears that the easements hereinafter described are unnecessary for present or prospective public use; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the City Council of the City of San Rafael, California, hereby elects to proceed under the PUBLIC SERVICE EASEMENTS VACATION LAW of the State of California; 2. That the City Council of the City of San Rafael, California, hereby declares its intention to close, vacate and abandon the easements hereinafter described; 3. That Monday, the 17th day of Anril , 19_1-, at 8:00 o'clock P.M., in the Council Chambers at the City Hall in the City of San Rafael, California, is hereby set as the time and place for hearing all persons interested in the proposed closing, abandoning and vacation of said easements; 4. That the Department of Public Works of the City of San Rafael shall post conspicuously notices of easement vacation along the line of the said easements proposed to be closed, abandoned and vacated, which notices shall be posted not more than three hundred feet apart but at least three notices shall be posted as to each such easement proposed to be closed, abandoned and vacated. The said notice shall state the time and place of the hearing, as hereinabove provided, and the adoption of the within resolution of intention; 5. That said easement proposed to be closed, abandoned and vacated are described on Exhibit "A", which is attached hereto and incorporated herein by reference; 6. That a map or plan showing said easements proposed to be closed, abandoned and vacated, is on file in the office of the City Clerk of the City of San Rafael at the City Hall, San Rafael, California. 1, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City on the day of Marc Monday � nth_-.-._---- 19 Z2 by the following vote, to-w1t: AYES: COUNCILMEN : Barbier, Jensen, Miskimen, Mulryan and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN : None MARION A. GRADY, City Clerk (20 Oakmont Court - Drainage Easement) PORTION OF A 10 FOOT WIDE DAINAGE EASEMENT TO BE ABANDONED ON LOT 3, "MAP OF OAKMONT COURT" (12 Maps at pg 14) Commencing at the most southwesterly corner of Lot 3 as shown on the final map of Oakmont Terrace, recorded on August 20, 1963 in Volume12 of Maps at page 14 Marin County Records; thence S 70° 03' 00" E, 10.00 feet; thence N 19° 57' 00" E, 90.00 feet to the true point of beginning; thence S 700 03' 00" E, 20.00 feet; thence N 190 57' 00" E, 10.00 feet; thence N 700 03' 00" W, 20.00 feet; thence S 19° 57' 00" W, 10.00 feet to the point of beginning.
