RESOLUTION OVERRULING PROTESTS, DRAINAGE MAINTENANCE
DISTRICT, EAST SAN RAFAEL DRAINAGE ASSESSMENT DISTRICT
NO. 1, CITY OF SAN RAFAEL, MARIN COUNTY, CALIFORNIA
WHEREAS, on the 3rd day of April, 1972, the City Council of
the City of San Rafael, Marin County, California, adopted its Resolu-
tion fixing time and place for hearing on Drainage Maintenance District,
East San Rafael Drainage Assessment District No. 1, City of San Rafael,
Marin County, California; and
WHEREAS, said resolution fixed the 15th day of May, 1972, at
the hour of 8:00 o'clock P.M. of said day, at the meeting place of the
City Council of the City of San Rafael, located in the Council Chambers,
1400 Fifth Avenue, San Rafael, California, as the time and place for hear-
ing protests with relation to the formation of the proposed Drainage
Maintenance District, the work proposed to be done therein, or to the
extent of said drainage maintenance district; and
WHEREAS, protests or objections were filed in writing by cer-
tain persons, firms or corporations who were interested in certain of
the property within the boundaries of said Drainage Maintenance District,
which said protests or objections were delivered to the City Clerk not
later than the hour set for hearing such objections; and
WHEREAS, at the time set for hearing the protests and objections,
said City Council of the City of San Rafael proceeded to hear the same,
and all of the protests or objections of every kind and nature having
been heard and duly considered;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael, Marin County, California, that all of said protests
and objections of every kind or nature be, and the same are hereby, over-
ruled or denied; and
IT IS HEREBY RESOLVED that the City Council finds that said
protests and objections are made by the owners of less than one-half of

the area of the property to be assessed for the work proposed to be
done in said Drainage Maintenance District.
I HEREBY CERTIFY that the foregoing resolution was duly and
regularly adopted by the City Council of the City of San Rafael, Marin
County, California, at a regular meeting thereof, held on the 15th day
of May, 1972, by the following vote, to wit:
AYES: Councilmen: Barbier, Jensen, Miskimen, Mulryan and Mayor Bettini
NOES: Councilmen: None
ABSENT: Councilmen: None
