RESOLUTION OF PRELIMINARY DETERMINATION TO UNDERTAKE SPECIAL
ASSESSMENT PROCEEDINGS AND SETTING TIME AND PLACE OF HEARING
THEREON, IN CONNECTION WITH BAHIA DE RAFAEL INDUSTRIAL PARK
ASSESSMENT DISTRICT, CITY OF SAN RAFAEL, 1�ARIN COUN'T'Y, CALIFORNIA
WHEREAS, the City Council of the City of San Rafael, Marin
County, California, has adopted a map showing the boundaries of pro-
posed Bahia de Rafael Industrial Park Assessment District, City of
San Rafael, Marin County, California, which said map is entitled '*Pro-
posed Boundaries of Bahia de Rafael Industrial Park Assessment Dis-
trict, City of San Rafael, Marin County, California;"
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael, Marin County, California, as follows:
1. The City Council proposes to implement special assess-
ment proceedings under the provisions of the Municipal Improvement
Act of 1913, with bonds to be issued under the provisions of the Im-
provement Act of 1911 of the State of California, for the purpose of
the construction of improvements and acquisitions to be made.
2. Monday, the 19th day of June, 1972, at the hour of
8:00 o'clock P.M. of said day, in the Council Chamber of the City
of San Rafael, 1400 - 5th Avenue, San Rafael, California, is hereby
fixed as the time and place for a public hearing when and where any and
all persons interested may appear and show cause, if any they have,
why the City Council of the City of San Rafael should not find and
determine that the public convenience and necessity require the pro-
posed improvements and acquisitions hereinabove described, without
compliance with the Special Assessment Investigation, Limitation and
Majority Protest Act of 1931.
3. The time and place of hearing shall be given in accord-
ance with the provisions of Ordinance No. 590 of the City Council
of the City of San Rafael.
4. The district which shall bear the cost and expenses of
said improvements and acquisitions, including all incidental expenses,
and which is to be assessed to pay for the costs thereof, is that
district shown on a map which is on file in the office of the City
Clerk of the City of San Rafael, and designated "Proposed Boundaries
of Bahia de Rafael Industrial Park Assessment District, City of San
Rafael, Marin County, California."
5. Said district shall be known and designated as "Bahia
de Rafael Industrial Park Assessment District, City of San Rafael,
Marin County, California."
I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the City Council of the City of San Rafael,
Marin County, California, at a regular meeting thereof, held on the
15th day of May, 1972, by the following vote, to wit:
AYES: Councilmen Barb ier, Jensen, Miskimen, Mulryan and Mayor Bettini
NOES: Councilmen None
