RESOLUTION ACCEPTING GRANT OF ACCESS EASEMENT
WHEREAS, public interest, convenience and welfare require that the
easement hereinafter mentioned be accepted and used for the benefit of the public
of the City of San Rafael, California;
NOW, THEREFORE, be it hereby resolved by the City Council of the City of
San Rafael, California, that that certain grant of right-of-way for access for the
maintenance, repair, reconstruction and renewal of public drainage facilities,
executed by McKEON CONSTRUCTION CO.
to the City of San Rafael, dated June 20, 1972 be and the same
is hereby accepted and the Clerk of said City is hereby directed to cause said
conveyance to be duly recorded in the Office of the County Recorder of the County
of Marin, State of California, forthwith upon the adoption of this Resolution.
I, MARION A. GRADY, Clerk of the City of San Rafael, California hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular meeting of the Council of said City held on Monday,
the 3rd day of July , 1972, by the following vote, to -wit:
AYES: COUNCILMEN. Barbier, Miskimen, Mulryan and Acting Mayor Jensen

OF DRAINAGE FACILITIES ONLY.
MCKEON CONSTRUCTION, a California corporation (hereinafter called "Grantor without
regard to number or gender) for an adequate consideration hereby GRANTS and Conveys to
THE CITY OF SAN RAFAEL, a municipal corporation, an EASEiIENT over the strip of land
hereinafter described for the purpose of access for the maintenance of drainage facilities
only granting the right of ingress thereto and egress therefrom, in, on and across said
strip of land and the contiguous real property of Grantor.
SAID STRIP of land is located in the City of San Rafael, County of Marin, State
of California, and is more particularly described as follows:
A PORTION of Lot 2, as shown upon the "l -lap of Bahia de Rafael Unit 1, a
Condominium, City of San Rafael, County of Marin, State of California"
recorded April 14, 1972 in Book 15 of Maps, at Page 14, Marin County
Records, more particularly described as follows:
BEGINNING at the Northeast corner of said Lot 2 (15 'taps 14); thence along
the exterior boundary of said 'Map of Bahia de Rafael Unit 1" (15 Maps 14)
North 69' 32' 00" 41est 78.50 feet; and thence South 20a 28' 00" West 7.50
feet to the Northerly boundary of the Drainage Channel Right -Of -Hay described
in Parcel Two of the Deed from Kerner-Bellan Realty Company to City of San
Rafael, recorded October 8, 1964 in Boot: 1865 of Official :records, at Page
517, Marin County Records; thence leaving said exterior boundary and continuing
along said Northerly boundary (186S O.R. 517) South 69' 32' 00" East, 21.00
feet and thence Southerly along a curve to the right, tangent to the preceding
course, having a radius of 57.50 feet, through a central angle of 90' 00' 00"
for a distance of 90,32 feet to said exterior boundary (15 Haps 14); thence
leaving said 'Northerly boundary and continuing along said exterior boundary,
(15 Maps 14) North 20° 28' 00" East 65.00 feet to the point of beginning.
GRANTOR shall not plant, place or deposit anything in or on said strip of
land which will damage or interfere with any of the rights granted hereunder nor shall
Grantor erect or construct any building or other structure or drill or operate any well
within said strip of land.
The provisions hereof shall inure to the benefit of and bind the heirs, successors,
and assigns of the respective parties hereto.
