HomeMy WebLinkAboutCC Resolution 4315RESOLUTION No. 4315 RESOLUTION OF INTENTION TO VACATE VARIOUS EASEMENTS WHEREAS, it appears that the easements hereinafter described are unnecessary for present or prospective public use; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the City Council of the City of San Rafael, California, hereby elects to proceed under the PUBLIC SERVICE EASEMENTS VACATION LAW of the State of California; 2. That the City Council of the City of San Rafael, California, hereby declares its intention to close, vacate and abandon the easements hereinafter described; 3. That Monday, the kith day of December , 1922, at 8:00 o'clock P.M., in the Council Chambers at the City Hall in the City of San Rafael, California, is hereby set as the time and place for hearing all persons interested in the proposed closing, abandoning and vacation of said easements; 4. That the Department of Public Works of the City of San Rafael shall post conspicuously notices of easement vacation along the line of the said easements proposed to be closed, abandoned and vacated, which notices shall be posted not more than three hundred feet apart but at least three notices shall be posted as to each such easement proposed to be closed, abandoned and vacated. The said notice shall state the time and place of the hearing, as hereinabove provided, and the adoption of the within resolution of intention; 5. That said easement proposed to be closed, abandoned and vacated are described on Exhibit "A", which is attached hereto and incorporated herein by reference; 6. That a map or plan showing said easements proposed to be closed, abandoned and vacated, is on file in the office of the City Clerk of the City of San Rafael at the City Hall, San Rafael, California. I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a adjourned regular meeting of the Council of said City on Wednesday , the 8th day of November _ 19 72; by the following vots, to -wit: AYES: COUNCILMEN Jensen, Miskimen, Mulryan and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None MARION A. WIDE SANITARY SEWER EASEMENT An Easement for Sanitary sewer lines with the right of ingress and egress for installation and maintenance purposes over a strip of land five feet in width, the center line of which is described as follows: BEGINNING at a point in the Southerly line of the parcel of land conveyed to J. Gazzola by Deed recorded July 31, 1951 in Liber 695 of Official Records at page 379, distant North 75° 02' West 34.50 feet from the end of theifirst curve in the above mentioned deed, running thence North 14° 30'. East 144.50 feet to the Southerly line of Fairhills Drive. EXHIBIT R
