RESOLUTION NO. 4364
RESOLUTION OF CONSENT TO
TRANSFER TERRITORY
A RESOLUTION, PURSUANT TO SECTION 35271 OF THE
GOVERNMENT CODE, CONSENTING TO THE TRANSFER
OF TERRITORY NOW IN THE CITY OF SAN ANSELMO,
AND OWNED BY ROBERT B. HAMILTON AND MR. AND
MRS. HARRY KUPBENS, TO THE CITY OF SAN RAFAEL
WHEREAS, ROBERT B. HAMILTON is the owner of real property
in the city to which ingress and egress is only possible over and upon a public
street of the City of San Rafael; and
WHEREAS, MR.AND MRS. HARRY KUPBENS are the owners of
real property in San Rafael a small portion of which lies within the City
of San Anselmo; and
WHEREAS, the Hamilton property is the only property on a dead-
end street not within the City of San Rafael and accordingly serious problems
have existed in respect to:
1 . Police and fire protection;
2. Confusion over the mail which comes through the
San Rafael post office but that which comes from
San Anselmo is often delayed;
3. Unnecessary work and expense in getting garbage
collection.
WHEREAS, THE Kupbens property which abuts the Hamilton prop-
erty should be totally in San Rafael for better efficiency and clarification;
and
WHEREAS, a small section of Alexander Avenue, abutting the
Hamilton property, is a San Rafael street and it should be transferred to
San Rafael because retention thereof by the City of San Anselmo is totally
unnecessary and would only compound the existing confusion; and
WHEREAS, the property owners have requested this transfer of
property,
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
The City Council of the City of San Rafael does hereby consent
to the transfer of the following described real property now in the City of
San Anselmo to the City of San Rafael pursuant to the procedures set forth
in Government Code sections 35270 et. seq.:

All of Parcel 71 and the portion of Parcel 8,
and the portion of Alexander Avenue as shown
on the Westland Terrace, San Rafael, Cali-
fornia, subdivision map dated 1946 (R. M . Bk. 6,
Page 18, County of Marin), located within the
City limits of San Anselmo, Calif.
Parcel 7 is that property owned by Robert B. Hamilton. The portion of
Parcel 8 is owned by Mr. and Mrs. Harry Kupbens . The portion of Alex-
ander Avenue is a public right of way.
Attached hereto and marked Exhibit A is an Assessor's map in
which the Hamilton property is delineated in red; the Kupbens parcel in
green, and the section of Alexander Avenue in brown.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of San Rafael held on the15th day of January , 1973
by the following vote to -wit:
AYES: COUNCILMEN : Jensen, Miskimen, Mulryan and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: None
