RESOLUTION NO. 4382
RESOLUTION AUTHORIZING EYECUTIGN OF AGREEMENT BETWEEN
THE COUNTY OF MARIN AND THE CITY OF SAN RAFAEL IN
CONNECTION WITH LUCAS VALLEY OPEN SPACE ASSESSMENT
DISTRICT, CITY OF SAN RAFAEL, MARIN COUNTY, CALIFORNIA
BE IT RESOLVED by the City Council of the City of San
Rafael, Marin County, California, that the Mayer of the City of
San Rafael be authorized to sign, and the City Clerk be authorized
to attest, that certain agreement between the City of San Rafael
and the County of Marin, which said agreement is attached hereto.
I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the City Council of the City of San Rafael,
Marin County, California, -at a regular meeting thereof, held on the
5th day of February, 1973, by the following vote, to wit:

A G R E E M E N.T
THIS AGREEMENT, made and entered into this 5th day of
February, 1973, by and between the COUNTY OF MARIN, a political
subdivision of the State of California, hereinafter referred to as
"County," and the CITY OF SAN RAFAEL, a municipal corporation of
the State of California, located within the County of Marin,
hereinafter referred to as "City,"
W I T N E S S E T H:
WHEREAS, City has created an assessment district under
the provisions of the Municipal Improvement Act of 1913, with bonds
to be issued under the provisions of the Improvement Bond Act of 1915
for the purpose of constructing major drainage facilities and street
improvements known as, "Lucas Valley Open Space Assessment District,
City of San Rafael, Marin County, California;" and
WHEREAS, County performs the service of collecting the
assessments on the tax roll as required under the provisions of the
Improvement Bond Act of 1915, and for which service the County re-
ceives the statutory compensation; and
WHEREAS, City desires that County, by and through its Tax
Collector -Treasurer and Registrar, perform, on behalf of City, required
services as paying agent to make all payments of interest coupons for
said issue in Lucas Valley Open Space Assessment District;
FOLLOWS:
NOW, THEREFORE, THE PARTIES HERETO DO HEREBY AGREE AS
1. County hereby agrees to perform the following services
for and on behalf of City in connection with its improvement bonds
issued pursuant to the Improvement Bond Act of 1915, to wit:
a. Collection of payments made during the thirty (30)
day cash collection period.
b. Payment of all coupons.
c. Payment of bonds at maturity or when entire principal
amount is called for redemption and to register
bonds when required.
d. Register of bonds when required to do so.
e. All administrative and clerical services required
in connection with the foregoing.
2. For and in consideration of the services to be performed
by County, City hereby agrees to pay to the County the sum of
Twenty-five Dollars ($25.00) per bond.
3. It is hereby understood by the parties'hereto that this
agreement shall apply only to the named bonds issued, to wit:
Lucas Valley Open Space Assessment District, City of San Rafael,
Marin County, California, dated April 2, 1973.
IN WITNESS WHEREOF, the parties hereto have authorized their
duly authorized representatives to execute the within instrument,
the day and year in this agreement first above written.
