HomeMy WebLinkAboutCC Resolution 4435RESOLUTION NO. 4435 A RESOLUTION AUTHORIZING THE SIGNING OF A LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RE- SOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a lease or agreement with City -County Planning Council of Marin , a copy of which is hereby attached and by this reference made a part hereof. I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and re- gularly introduced and adopted at a regular meeting of the Council of said City held on Monday the 5th day of March , 19 73 , by the following vote, to - with. GRADY - City Verk CI'I V -COUNTY PLANNING COUNCIL OF MARI N A G R E E M E N T THIS AGREEMENT made and entered into by and between the County of Marin and the Cities of San Rafael Witnesseth: WHEREAS, the development of the County required governmental agencies to find answers to many problems which requires study and action on an area -wide •basis and which cannot be solved by any one.city of the County alone; and WHEREAS, it is necessary and desirable to establish an entity which will represent the cities, and the County in order to facilitate in the discus - Sion and study of such problems and the development of recommendations for the solution thereof; and WHEREAS, title 1, Division 7, Chapter 5 of the Government Code of the State of California authorizes the joint exercise by agreement of two or more pub- lic agencies of any power common to them; and Title 7, Chapter 3,.Article 11 of the Government Code of the State of California aurhori7Pc the creation of an "Area Planning Commission" (herein designated City -County Planning Council of Marin); and WHEREAS, the parties hereto possess, in common, the power to study, discuss and recommend policies for the solution of County problems of direct con- cern to the performance of their constitutiona•1 and statutory functions, and to expend public funds for these purposes. • NOW, THEREFORE, in consideration of the mutual terms, covenants and conditions herein agreed, the parties thereto agree as follows: 1. The parties hereto shall participate in a City -County Planning Council of Marin (hereinafter known as CCPC), which is hereby established to accomplish the purposes of this agreement. ' 2. The CCPC is hereby empowered to: a. Prepare a county -wide general plan. b. Study regional or State agency plans including ABAG, BATS, CDC, Bay Toll Crossings, State Division of Highways, State Division of Parks. C. Study at i t5 c -,,n c i sc re;ion, -a;;e. s refe-re,; ;c :z Ey z -,,.C' Council, the Board of Supervisors or other responsible governmenta agency. 3. Members of the CCFC shall be: a. One Councilman from each City that is a party to this agreement. 5.- One member of the Planning Commission of each City which is a party to this agreement. c. Two members of the County Board of Supervisors. , d. Two members of the County Planning Commission. e. Each member shall serve so long as he holds office or until he resigns or is removed by his appointing body. 4. Each member of the CCPC shall have one vote. 5. The County shall provide staff, services, facilities, funds and personnel necessary to carry out the functions of the CCPC. County activities under this agreement shall be subject to strict accounta- bility, and periodic reports thereof shall be made to the CCPC. 6. The Marin Planning Staff Coordinating Committee shall serve as an official advisory body to the CCPC. 7. A majority of the membership shall constitute a quorum. Any action. shall be by favorable majority vote of the membership. The City - County Planning Council shall elect officers. appoint committees, and establish rules for meeting procedure. 8. The planning powers of said CCPC shall be advisory only. Nothing herein shall be construed as limiting in any manner the power of any of the respective parties to initiate and complete a local project.within their respective jurisdictions with their own funds. Nothing herein shall be construed to reduce the powers of the re- spective parties in the areas'of zoning, subdivision, general plan- ning, freeway agreements, and similar activities as provided by State Statutes. 9. The Chairman of the Marin County Board of Supervisors shall call the organizational meeting of CCPC. 10. This agreement shall beeffectiveupon its execution by the County of Marin and a majority of the Cities, and shall remain in effect for a period of three years or until rescinded or terminated.by a majority of the parties hereto. At the end of three years the parties hereto at their discretion may extend this agreement. -2- IN WITNESS WHEREOF, the respective parties hereto have caused this instrument to be executed on the indicated date, by their duly authorized representatives.
