RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
DECLARING THAT MUD LANDSLIDE ON LANDS OF N. Y. CAL INDUSTRIAL
CORP. ARE A NUISANCE.
WHEREAS, pursuant to Title 1, Chapter 1.16, Sections 1.16.030
and 1.16.040 of the Municipal Code of the City of San Rafael, N. Y.
Cal. Industrial Corp was notified to appear before the City Council
on March 12, 1973 to show cause, if any they had, why the mud land-
slide on their property, adjacent to the Lyndenwood Court area was
not a public nuisance; and
WHEREAS, pursuant to Section 1.16.050 a hearing was duly held
before the City Council of the City of San Rafael; and
WHEREAS, said hearing was had on March 12, 1973, but a deter-
mination was continued to March 19, 1973, and after considering the
oral evidence that was presented at the hearing on March 12, 1973,
and after considering the briefs that were filed on behalf of the
property owners and on behalf of N. Y. Cal. Industrial Corp. the
determination was made.
NOW THEREFORE, BE IT RESOLVED, that the City Council of the
City of San Rafael does hereby declare that the mud landslide, to-
gether with the debris in the area adjacent thereto, all of which
is adjacent to the Lyndenwood Court area, does hereby constitute a
public nuisance and is declared to be so.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby
certify that the foregoing Resolution was duly and regularly intro-
duced and adopted at a regular meeting of the Council of the City of
San Rafael held on the � � ay of0:1a(124 1973, by the following
vote, to -wit:
AYES: COUNCILMEN: Mulryan, Miskimen and Mayor Bettini.
NOES: COUNCILMEN: Jensen.
ABSENT: COUNCIL EN: None
