HomeMy WebLinkAboutCC Resolution 4470RESOLUTION NO. 4470 RESOLUTION APPROVING ANNEXATION TO THE CITY OF SAN RAFAEL OF UNINHABITED TERRITORY LYING ADJACENT THERETO DESIGNATED AS "WAGNER ANNEXATION". WHEREAS, there has been filed with the City Council as the legislative body of the City of San Rafael, a municipal corporation, a written Petition containing a description of the uninhabited ter- ritory described on Exhibit "A" which is attached hereto and incor- porated herein by reference, which territory is contiguous to land lying within the boundary of said City, requesting therein that said territory be included in such municipal corporation; and WHEREAS, it appears that it will be to the advantage, benefit and best interest of said City to annex said territory to said munici- pal corporation; and WHEREAS, said annexation proceedings are being taken under the provisions of "Annexation of Uninhabited Territory Act of 1939"; and WHEREAS, said Petition has been signed by or written consent has been filed by the owners of all of the land in the territory pro- posed to be annexed and they_ have all given their written consent that the property within the territory proposed to be annexed shall be taxed to pay any indebtedness or liability of the City of San Rafael con- tracted prior to or existing at the time of annexation; and WHEREAS, an application for the above described annexation has heretofore been filed with the "Local Agency formation Commission" which application is and was signed by all of the owners of land with- in the territory proposed to be annexed; and WHEREAS, the "Local Agency Formation Commission" did, on the 12th day of July, 1972, approve the annexation of said uninhabited territory of the City of San Rafael and pursuant to Section 54797.1 of R01111 GINA[ 1 the Government Code of the State of California, the said "Local Agency Formation Commission" approved and authorized the Council of the City of San Rafael to annex said territory without notice and hearing by the said Council; and WHEREAS, no protest has been made against the above described annexation; and WHEREAS, th.e said City Council approves the annexation of the territory described as Exhibit "A" to the City of San Rafael and elects to proceed with said annexation. NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS: 1. The said City Council hereby approves the annexation of the territory described on Exhibit"A" to the City of San Rafael, and said territory is hereby annexed to the City of San Rafael. 2. That the territory herein annexed is all that certain real property situated in the County of Marin, State of California, des- cribed on Exhibit "A" which territory is hereby designated as "Wagner Annexation". 3. The said territory is hereby subjected to taxation after annexation equally with property within the City of San Rafael, to pay any and all indebtedness or liability of the said City contracted prior to or existing at the time of annexation. 4. The Clerk of the City of San Rafael shall immediately pre- pare under the seal of the City of San Rafael, a certified copy of this Resolution, giving the date of its passage, and transmit it to the Secretary of State of California. Tibbetts to Royal M. Prescott, by deed dated February 2, 1921 and recorded in Book 225 of Deeds, at page 52, Marin County Records; running thence South 53° 20' East 71.8 feet; thence South 59° 19' East 173.2 feet; thence running South 37° 34' East 133.8 feet; thence South 47° 28' East 103.3 feet; thence South 56° 32' East 70.3 feet; thence South 63° 15' East 142.42 feet; thence South 57° 58' East 37.58 feet; said point being the point of be- ginning of the description of this annexation. From said point of beginning on a line running North 34° East 645.5 feet; thence North 56° 0' West 170.65 feet; thence South 34° 0' West 618.5 feet; thence North 39° 02' West 52.27 feet; thence North 34° 0' East 130 feet; to a point on the North side of Fifth Avenue; thence on a line South 44° 03' East 68.32 feet; thence South 57° 58' East 54.2 feet to the point of beginning.
