HomeMy WebLinkAboutCC Resolution 4542RESOLUTION NO. 4542 A RESOLUTION AUTHORIZING THE SIGNING OF A LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a lease or agreement with the COUNTY OF MARIN a copy of which is hereby attached and by this reference made a part hereof. I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regu- larly introduced and adopted at a regular meeting of the Council of said City held on Monday the 6th day of August , 19 73 , by the following vote to - wit: AYES- COUNCILMEN Jensen, Nixon and Acting Mayor Miskimen. GRADY, City Clerk 1R1ri�as r_"V1!1:—:„'YEN1AL CONE 7” 49 `'eI/ AUG 13 1973 DEPARTMENT OF Hcri—• rr�%ICEC AGREEMENT 1 y c THIS AGREEMENT, made and entered into this 28th day of August , 1973, by and between the COUNTY OF MARIN, a political subdivision of the State of California, hereinafter referred to as "County" and the City of San Rafael , a political subdivision of the State of California, hereinafter referred to as "City". WITNESSETH WHEREAS, pursuant to Division 1, Part 2, Chapter 1, Articles 2 and 2a of the California Health & Safety Code; City and County may enter into agreements authorizing the County Health Officer to enforce and observe within City certain statutes, ordinances and regulations per- taining to public health and sanitation and the making of all inspections and performance of all functions in connection therewith: WHEREAS, City and County have determined that the public interest would be best served by the performance of these functions as provided in this Agreement: NOW THEREFORE, pursuant to the aforesaid authorities and in consideration of the mutual promises and covenants as set forth herein the parties hereto agree as follows: 1 . State Law. The Marin County Health Officer will enforce and observe in the City all orders, quarantine regulations and rules prescribed by the State Department of Public Health and other rules and regulations issued under the provisions of the California Health & Safety Code and statutes relating to the public health. 2. City Health Functions. The Marin County Health Officer shall perform all functions relating to the enforcement in the City of all ordinances thereof relating to public health and sanitation, and the making of all inspections and the performance of all functions in connection therewith. 3. Fees to Pay Expenses of Health Officer. All costs to County for performances of services provided within the City under this Agreement shall be recouped from permit fees. Whenever County's Board of Supervisors determines that the expenses of its Health Officer in the enforcement of any statute, order, quarantine, rule or regulation prescribed by a State Officer or Department relating to the public health are not met by any fees prescribed by the State, the Board of Supervisors may adopt an ordinance prescribing such fees as will pay the reasonable expenses of such Officer incurred in such enforcement-. The fee schedule so prescribed shall be applicable in the area in which the Health Officer enforces any statute, order, quarantine, rule or regulation prescribed by a State Health Officer or Department relating to public health. Likewise, if City's ordinances to be enforced by County pursuant to this Agreement do not provide for fees sufficient to reimburse County for its enforcement expenses then County's Board of Supervisors may adopt an ordinance prescribing such fees as will pay the reasonable expenses of its Health Officer incurred in such enforcement. 4. Fee Billing. As part of the services to be provided pursuant to this Agreement, County shall be responsible for billing and collecting all applicable fees. 5. Administration. All environmental services to be provided hereunder shall be under the general supervision of the Director of the Division of Environmen- tal Control of the Marin County Department of Health Services: County will provide City with a qualified Sanitarian whose function will be to supervise the aforementioned services. 6. Term. The services of the County Health Officer in the City shall com- mence on the day of , 197 , and shall continue indefinitely until such time as City causes the Agreement to be legally amended or ter- minated. This Agreement may be terminated by either party at any time by the written notification of such intent at least thirty (30) days prior to expir- ation. 7. Notice. Certified copies of the resolutions or ordinances authorizing adoption of this Agreement by the respective governing bodies of the parties hereto shall be forthwith served upon the City Clerk and the Clerk of the Board of Supervisors. B. Prior Agreements. Adoption of this Agreement supersedes any prior agreements to the extent they are inconsistent herewith. -2- IN WITNESS WHEREOF, the parties hereto have executed this Agreement in duplicate effective the day and year first above written.
