A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as
follows:
The ENGINEER OF WORK is authorized to execute, on behalf
of the East San Rafael Drainage Assessment District No. 2, a
service agreement with:
HARDING-LAWSON ASSOCIATES for soils report,
a copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the Council of said City held on
Monday the 20th day of August, 1973, by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: None.

This Service Agreement is made this 26th day of June, 1973,

subsequently referred to as CLIENT, and HARDING-LAti]SON ASSO-
CIATES, a California Corporation, subsequently referred to as
CONSULTANT.
II.
By joining in this .Agreement, Client retains Consultant to provide
Consulting Engineering services in connection with the East San
Rafael Drainage Assessment District No. 2, subsequently referred
to as PROJECT.
By this Agreement the scope of Consultant's services on Project
is limited to providing
Part A. Drainage Facilities
1. Evaluate stability of the proposed
channel slope configurations and,
if required, provide criteria for
improving the stability of drainage
channel and pond perimeter slopes

2. Recommendations for design lateral
pressures and foundation support at
the pump station; i.e. bearing pres-
sures, depth and width criteria, or
estimates of pile lengths and capac-
ities, if required.
3. Estimates of probable settlement o.f
the pump station site and outfall
line.
Part B. Levee Evaluation
1. Recommendations for repair of the bay
front levee consistent with an interim
"predevelopment" condition
2. Evaluation of slope stability under the
conditions after site development and
recommendations for slope stability_
improvement, if required
3. Evaluation of overall levee stability
under seismic conditions
Client understands and agrees that Consultant will develop infor-
mation and recommendations by drilling, logging and sampling about
10 test borings, 25 to 70 feet deep, by performing laboratory
tests on selected samples and performing engineering analysis of
the data obtained. Drilling will be performed by a drilling con-
tractor retained by Consultant on Client's behalf. The logging
and sampling of test borings and subsequent laboratory testing
will be performed by Consultant solely to fulfill the purpose of
this Service Agreement and Consultant is not responsible for other
use or interpretation of the information developed. Client
recognizes that subsurface conditions beneath Project site may
vary from those encountered at test boring locations and that

information and recommendations developed by Consultant are based
solely on the information available to him.
IV.
Consultant agrees to provide services covered by this Agreement on
a time -and -expense basis as determined -by the Schedule of Charges
which is part of this Agreement'. Consultant estimates that fee
for these services will be about $6000. This amount will not be
exceeded for the services covered by this Agreement. If project
requirements, or the subsurface conditions encountered, indicate
that the scope of services (including the number of test borings)
covered by this Agreement should be revised, an additional Service
Agreement shall be entered into to cover the revised scope.
Consultant will submit progress invoices to Client monthly and a
final bill upon completion of the services. Payment of all
invoices rendered prior to sale of the bonds are due upon sale of
bonds and are past due 30 days thereafter. All subsequent invoices
are due on presentation and are past due 30 days from the invoice
date. It is understood that the City of San Rafael is not liable
for payment of the invoices.

TRAVEL TIME
Travel time will be charged at regular hourly rates, eight
hours maximum per day.
OUTSIDE SERVICES
Rental of test drilling equipment and special equipment not.
ordinarily furnished by the Engineer and all othercosts
such as laborer, special printing, telephone, travel by
common carrier, subsistence, etc. Cost plus 10
Billings are payable upon presentation and are past due 30 days frorn invoice date. A fill -H10'
charge of 146 per month will be charged on past due accounts.
