A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL CONSENTING TO THE COMMENCEMENT OF PROCEEDINGS
FOR THE ANNEXATION OF CERTAIN INHABITED TERRITORY
DESIGNATED AS "COUNTRY CLUB' ANNEXATION"
WHEREAS, on the 20th day of June
, 1973, an application
was filed with the Local Agency Formation Commission applying for
annexation of certain inhabited territory therein referred to and
generally described, which is contiguous to the Citv of San Rafael;
and
WHEREAS, the Local Agency Formation Commission by Resolution
No. 73-17 , approved on August 8, 1973, the annexation of that
certain inhabited territory subject to the following conditions:
and;
(a) The Citv of San Rafael prezone the area of the
proposed annexation, such prezoning to be completed prior
to the date of any election.
(b) The water distribution system be upgraded., where
necessary, as specified by the City of San Rafael, the cost
to be borne by the residents benefiting from such improvements.
WHEREAS, said application for annexation was referred to the
Planning Commission of the City of San Rafael for investigation,
report and recommendation; and
WHEREAS, the Planning Commission rendered its report and recom-
mendation to the council on the 30thday of July 197 3 , favoring
the commencement of annexation proceedings; and
WHEREAS, it is the desire of the City Council to give its consent
to the commencement of such annexation proceedings upon condition that
the electors within said territory be informed at the time the petition
for annexation is circulated that the question to be submitted to said
electors shall be whether the territory shall be annexed, and the pro-
perty in the territory subjected to taxation after annexation equally

with the property within the City of San ?tafael to pay the entire
bonded inde'ateOness of the Citv of Gan Rafael outstanding or auth-
orized at the date of the first vuhlication or the notice of election,
for the acquisition, construction or cornletior_ of municipal im-
provements.

I:T VT, THEREF'ORF, LF IT RESOLVED by the City Council of the City
of San Rafael:
1. That consent be and herebv is Granted for the conr,encement
of annexation proceedings in connection_ -v7ith said inhabited territory
in accordance with the Annexation Act of 191.3, provided the petition
for annexation contains a request that the question to be submitted
to the electors residinG in the terr.itory proposed to he annexed
shall be whether the territory shall he ann_exer?, znc! the property
in the territory subject to taxation after annexation ecxually with
property Teithin the City of San Rafael to pay the bonded indebtedness
of the City of San Rafael outstanding or authorized at the date of
the first publication of the notice of election for the acquisition,
construction or cor:p].etion of nunicirzl improvements.
2. That said unincorporated territory be and hereby is Oesianated
as "Country Club Annexation" ant' 9.s described in Exhibit A attached
hereto.
3. The City Clerk shall certify to the adoption of this resolution.
