RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL EXCEPTING MARIN YACHT CLUB and SESSIONS RISE
FROM ORDINANCE NO. 1120 SO AS NOT TO REQUIPr A PLANNED
UNIT DEVELOPMENT SUBMITTAL.
WHEREAS, the Citv Council of the Citv of San Rafael by
Ordinance 41120 adopted an Urgencv Ordinance requiring that
all new condominium developments by submitted as a Planned
Unit Development; and
WHEREAS, there has been applied for and is pending, two
condominium projects entitled. Marin Yacht Club and Sessions
Rise; and
WHEREAS, both projects have progressed and are almost
complete as far as approvals are concerned; and
WHEREAS, it would be inequitable to now require these two
projects to be resubmitted as Planned Unit Developments. It is
hereby determined that these projects should be excepted from
the operation of Urgency Ordinance No. 1120.
NOW, THEREFORE, BE IT RESOLVED:
That Marin Yacht Club and Sessions Rise, two
condominium projects, approvals for which are now
pending before the City, are herebv exempted from the
operation of Ordinance No. 1120, which ordinance
would require them to submit their applications as
a Planned Unit Development.
I, MARION A. GRADY, Clerk of the City of San Rafael, herebv
certify that the foregoing Resolution was duly and regularly intro-
duced and adopted at a regular meeting of the Council of said City
held on the 17th day of September, 1973, by the following vote, to -wit:
AYES: COUNCILMEN: Mulrvan, Jensen, Miskimen, Nixon and
Mayor Bettini
NOES: None
ABSENT: None.
