RESOLUTION OF ANNEXATION TO THE CITY OF SAN RAFAEL
OF UNINHABITED TERRITORY LYING ADJACENT THERETO DESIGNATED
AS "WINTERGREEN TERRACE ANNEXATION".
WHEREAS, The City of San Rafael, a municipal corporation,
is the owner of the uninhabited territory described on Exhibit
"A" which is attached hereto and incorporated herein by reference,
which territory is contiguous to land lying with the boundary of
said City; and
WHEREAS, it appears that it will be to the advantage, benefit
and best interest of said City to annex said territory to said
municipal corporation; and
WHEREAS, said annexation proceedings are being take under
the provisions of "Annexation of Uninhabited Territory Act of
1939"; and
WHEREAS, an application for the above described annexation
has heretofore been filed with the "Local Agency Formation Com-
mission" which application was presented by the City of San Rafael
as owner of the land; and
WHEREAS, the "Local Agency Formation Commission" did, on the
12th day of September, 1973, approve the annexation of said unin-
habited territory of the City of San Rafael and pursuant to Section
54797.1 of the Government Code of the State of California, the said
"Local Agency Formation Commission" approved and authorized the
Council of the City of San Rafael to annex said territory, without
notice, hearing or election by said City; and
WHEREAS, no protest has been made against the above described
annexation; and
IVHEREAS, the said City Council approves the annexation of the
territory described as Exhibit "A" to the City of San Rafael and

elects to proceed with said annexation.
NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS:
1. The said City Council hereby approves the annexation of
the territory described on Exhibit "A" to the City of San Rafael,
and said territory is hereby annexed to the City of San Rafael.
2. That the territory herein annexed is all that certain
real property situated in the County of Marin, State of California,
described on Exhibit "A", which territory is hereby designated
as "Wintergreen Terrace Annexation".
3. The Clerk of the City of San Rafael shall immediately
prepare under the seal of the City of San Rafael, a certified
copy of this Resolution, giving the date of its passage, and trans-
mit it to the Secretary of State of California.

;from the most easterly corner of Lot 8 of "Las Colindas Unit One",
according to the map thereof recorded in Book 8 of Maps at page 10,
Marin County Records; thence N71°4411 along the northerly boundary
line of said "Las Colindas Unit One", 445 feet, as described in that
particular Deed as recorded April 2, 1970 in Book 2364 of Official
Records at page 545, Marin County Records, to the true point of begin-
ning of the parcel herein described; proceeding from said true point of
beginning N71°44' W 225 feet to a point on the northeasterly extension
1 of the northwesterly line of Wintergreen Terrace, as shown upon the map
of "Las Colindas Unit Three", recorded March 11, 1955 in Book 8 of Qps
at page 41, Marin County Records; thence N18°16'00" E 10 feet; thence
S71°44'E 225 feet; thence S18°16'00" W 10 feet to the true point of
beginning. This parcel contains 0.052 acres, more or less.
