RESOLUTION REJECTING CONSTRUCTION BIDS AND CALLING FOR
NEW BIDS, MOORING ROAD SEWER ASSESSMENT DISTRICT, CITY
OF SAN RAFAEL, MARIN COUNTY, STATE OF CALIFORNIA
WHEREAS, on October 15, 1973, the City Council of the
City of San Rafael set a hearing on the Engineer's Report for Moor-
ing Road Sewer Assessment District, City of San Rafael, Marin County,
State of California, to be held on November 19, 1973, and called
for bids for the construction of public improvements in said
assessment district, said bids to be received on November 8, 1973;
and
WHEREAS, at the time set for the opening of construction
bids, two bids were received, and said bids were for amounts
substantially higher than the Engineer's Estimate of the cost of
construction,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael, Marin County, State of California, as follows:
That the bids of Maggiora & Ghilotti, Inc., and McGuire and
Hester for construction of the improvements in Mooring Road Sewer
Assessment District, City of San Rafael, Marin County, State of
California, are hereby rejected.
That bids shall be received for the construction of improve-
ments in said Mooring Road Sewer Assessment District on the 3rd day
of January, 1974, at 10:00 o'clock A.M. of said day. Said bids or
proposal shall be delivered on or before 10:00 o'clock A.M., on the
3rd day of January, 1974, at the office of the City Clerk of the City
of San Rafael, City Hall, 1400 Fifth Avenue, San Rafael, California,
at which time said bids will be publicly opened, examined and declared
by the City Clerk of the City of San Rafael. Said bids after being
publicly opened, examined and declared will be calculated by the
Engineer of Work, his report returned to the City Clerk and the report
of the results of the bidding and the calculations of the Engineer of
Work will be reported to the City Council of the City of San Rafael.

The City Council reserves the right to reject any and all
proposals or bids should it deem this necessary for the public
good, and also the bid of any bidder who has been delinquent.or
unfaithful in any former contract with the City of San Rafael.
The improvements herein referred to shall be in accordance
with plans and specifications heretofore adopted by this City
Council on the 15th day of October, 1973.
The City Clerk is hereby directed to advertise for construc-
tion bids in the manner provided by law.
I HEREBY CERTIFY that the foregoing resolution was duly and
regularly adopted by the City Council of the City of San Rafael,
Marin County, State of California, at a regular meeting thereof,
held on the 3rd day of December, 1973, by the following vote, to wit:
