HomeMy WebLinkAboutCC Resolution 4631RESOLUTION NO. 4631 A RESOLUTION AUTHORIZING THE SIGNING OF A LEASE OP AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a lease or agreement with CITY OF SAN RAFAEL and WILLIAM J. BIELSER, City Manager. A copy of which is hereby attached and by this reference made a part hereof. i, MARION A. GRADY, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held on Monday the 3rd day of December 19 73 by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None MARION A. GRADY City Clerk AGREEMENT THIS AGREEMENT, made and entered into this th i rd day of December , 1973s by and between the CITY OF SAN IRAFAEL, a municipal corporation, hereinafter referred to as "City,' and WILLIAM J. BIE LSER, hereinafter referred to as "City Manager." WITNESSETH: In consideration of the mutual covenants and agreements contained herein, the parties hereby agree as follows- 1. ollows: 1. The City hereby employs City Manager to serve in the position of City Manager for a period of three years commencing on the date hereof. 2. City Manager agrees to perform the services required and as directed by City Council of the City of San Rafael, for the position of City Manager. 3. In consideration of the City Manager performing those services as required and directed by the City Council, he shall be compensated as follows: $26, 000.00 per annum, effective July 1, 1973. 4. Prior to July 1st of each succeeding year, the City Council shall re- view the City Manager's salary and may adjust said salary as they shall see fit. However, no reduction shall be made unless there is a decrease in the cost of living index from the preceeding year and said reduction shall not be greater than the percentage decrease as established by said index. The City Manager shall be entitled to all the fringe benefits given to other City employees a nd shall be furnished an automobile. 5. Termination: By City For Cause: In the event the City Manager is discharged by the City Council of the City of San Rafael for cause, he shall not be entitled to any severance pay. Cause shall be limited to those actions set forth in the Per - sonnet Rules and Regulations, Section 10, which would be grounds for discharge, dismissal or demotion by other City employees. By City Other Than For Cause: In the event the City Manager is discharged by the City Council for any reason other than for cause, City Manager may be div - missed forthwith, but shall be entitled to severance pay for six (6) months to be paid at the time the City Manager ceases working for the City. If the City Council requests the City Manager's resignation, it shall be treated as a termination re- quiring the payment of six months severance. By City Manager: In the event the City Manager desires to and does serve notice on the City of his election to terminate his employment, he shall give the City 60 days notice and shall not be entitled to any severance pay nor entitled to any pay for work not performed. 0� IN WITNESS WHEREOF, the parties hereto have entered into this Agreement the day and year first above written ATTEST: MARION A.
