A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL DECLARING THAT A MAJORITY PROTEST HAS BEEN MADE
REGARDING THAT ANNEXATION KNOWN AS COUNTRY CLUB
ANNEXATION.
WHEREAS, on the 17th day of December, 1973, the City Council of the City
of San Rafael as authorized by,Resolution No. 4608, held a public hearing to
permit owners of property in the territory proposed to be annexed to protest
the annexation; and
WHEREAS, at said hearing owners of 172 parcels filed protests pursuant to
Section 35120 of the Government Code; and
WHEREAS, protests against the annexation of the territory as described
in said Resolution No. 4608 to the City of San Rafael were filed by the owners
of more than one-half of the value of the territory to be annexed as provided
for in the Government Code.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN RAFAEL
AS FOLLOWS:
That the City Council hereby declares, pursuant to Section 35125.1 of the
Government Code of the State of California that a majority protest has been made
in accordance with Section 35121 of said Code at the hearing of protests against
the annexation to the City of San Rafael of certain inhabited territory described
as the Country Club Annexation.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby certify
that the foregoing resolution was duly and regularly introduced and adopted at a
regular meeting of the City Council of said City held on Monday, the 7th day of
January, 1974, by the following vote, to -wit:
AYES: COUNCILMEN: Miskimen, Mulryan, Nixon and Mayor Bettini
NOES: COUNCILMEN: Jensen.
ABSENT: COUNCILMEN: None.
