RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
PETITIONING THE BOARD OF SUPERVISORS OF THE COUNTY OF MARIN
TO EXCLUDE TERRITORY WITHIN THE BOUNDARIES OF SAID CITY FROM
COUNTY FIRE PROTECTION TAX PURSUANT TO GOVERNMENT CODE
SECTION 25643
WHEREAS, Government Code Section 25643 provides that the Board of
Supervisors of a county shall exclude from the county fire protection tax
those areas within the territorial limits of an incorporated city or special
district having an organized fire department in existence and operation
providing adequate fire protection within such territory, and
WHEREAS, this City hereby finds that such protection is being afforded
herein,
NOW, THEREFORE, BE IT RESOLVED that the City of San Rafael does hereby
petition the Board of Supervisors of the County of Marin, pursuant to the
provisions of Section 25643 of the Government Code, to exclude all territory
within the boundaries of the City of San Rafael, including all Property which
may hereafter be annexed to the City of San Rafael, from the County Special
Fire Tax.
BE IT FURTHER RESOLVED THAT the City Clerk of the City of San Rafael
are hereby directed to forward a copy of this Resolution to the Clerk of the
Board of Supervisors (through the Auditor -Controller's Office).
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said City held on
Monday the 7th day of January, 1974, by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: None.
