RESOLUTION NO.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL ACCEPTING DEED TO REAL PROPERTY
WHEREAS, the City of San Rafael did, on July 28,
1972, file a condemnation action seeking to acquire title
to certain parcels of real property in East San Rafael
for the purpose of constructing a drainage system; and
WHEREAS, two of the defendants and owners were
EQUITABLE DEVELOPMENT COMPANY, a limited partnership, and
MARIN DEVELOPMENT COMPANY, a limited partnership; and
WHEREAS, the City of San Rafael and Equitable Develop-
ment Company and Marin Development Company have entered an
agreement settling said condemnation action as to the defen-
dants Equitable Development Company and Marin Development
Company, whereby the condemnation action is being dismissed
as to said defendants, and said defendants are voluntarily
deeding the property needed by the City to the City for an
agreed amount of money; and
WHEREAS, said property is more particularly described
in Exhibit "A" attached hereto and made a part hereof by
reference; and
WHEREAS, a deed has been executed by said Equitable
Development Company and Marin Development Company, the owners
thereof, naming the City of San Rafael as grantee thereof;
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of San Rafael hereby accepts said deed on behalf
of said City.
I, the undersigned Clerk of the City of San Rafael
hereby certify that the foregoing Resolution was duly and
regularly introduced and adopted at a regular meeting of
the Council of said City held on the 21st day of January,
1974, by the following vote, to wit:

That certain real property situate in the City of San
Rafael, County of Marin, State of California, described as follows:
PARCEL ONE:
A portion of the 60.285 Acre parcel as shown on the "Record
of Survey of a portion of Section 2 & Section 11, T. 1 N., R. 6 W.,
Mount Diablo Meridian, San Rafael, California", recorded April 9, 1969
in Book 8 of Surveys at page 28, Marin County Records, more particu-
larly described as follows:
BEGINNING at the most westerly corner of said 60.285 Acre
parcel (8 O.S. 28); thence along the common boundary of said 60.285
Acre parcel and the 104.400 Acre parcel, as shown on said Record of
Survey (8 O.S. 28), South 140 31' 00" East, 677.33 feet to the true
point of beginning; thence leaving said common boundarnortherly
along a curve to the right whose center bears North 75 29' 00" East,
having a radius of 140.00 feet thru a central angle of 350 09' 18"
for a distance of 85.90 feet; thence North 200 38' 18" East, 1.76
feet; thence North 69° 21' 42" West, 32.48 feet to said common
boundary of said 60.285 Acre and 104.400 Acre parcels (8 O.S. 28);
thence along said common boundary, South 140 31' 00" East, 100.75
feet to the true point of beginning.
Containing 945 square feet more or less (0.0217 Acres).
PARCEL TWO:
A portion of the 60.285 Acre parcel as shown on the "Record
of Survey of a portion of Section 2 & Section 11, T. 1 N., R. 6 W.,
Mount Diablo Meridian, San Rafael, California", recorded April 9,
1969 in Book 8 of Surveys, at page 28, Marin County Records, more
particularly described as follows:
BEGINNING at the most westerly corner of said 60.285 Acre
parcel (8 O.S. 28); thence along the common boundary of said 60.285
Acre parcel and the 104.400 Acre parcel, as shown on said Record of
Survey (8 O.S. 28), North 750 46' 23" East, 595.38 feet; thence
leaving said common boundary, South 140 31' 00" East, 414.66 feet;
thence southerly along a curve to the right, tangent to the preceding
course, having a radius of 300.00 feet thru a central angle of 1250
09' 18" for a distance of 655.31 feet; thence North 690 21' 42" West,
150.00 feet to said common boundary of said 60.285 Acre and 104.400
Acre parcels (8 O.S. 28); thence along said common boundary, North
140 31' 00" West, 576.58 feet to the point of beginning.
Containing 392,038 square feet more or less (9.0000 Acres).
