RESOLUTION REDUCING AMOUNT TO BE WITHHELD FROM CONTRACTOR'S
PAYMENT, EAST SAN RAFAEL DRAINAGE ASSESSMENT DISTRICT NO. 1,
CITY OF SAN RAFAEL, MARIN COUNTY, STATE OF CALIFORNIA
WHEREAS, all of the construction work in the East San Rafael Drainage
Assessment District No. 1, City of San Rafael, Marin County, California, has been
completed by the contractor for said assessment district, with the exception of
certain additional items of work which were added to the construction contract for
the accommodation of this district; and
WHEREAS, pursuant to said construction contract the City of San Rafael
has retained 10% of the construction cost; and
WHEREAS, the Engineer of Work for said assessment district has recom-
mended to this Council that the amount of this retention be reduced to 2-1/2% of
the construction cost;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San
Rafael, Marin County, California, that the amount of said retention is hereby re-
duced to 2-1/2% of the contract cost.
I HEREBY CERTIFY that the foregoing resolution was duly and regularly
adopted by the City Council of the City of San Rafael, Marin County, California,
at a regular meeting thereof, held on the 21st day of January, 197 4 , by the
following vote, to wit:
AYES: COUNCILMEN Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini.
NOES: COUNCILMEN None.
ABSENT: COUNCILMEN None.
