HomeMy WebLinkAboutCC Resolution 4672RESOLUTION NO. 4672 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL APPROVING ANNEXATION OF UNINHABITED CONTIGUOUS TERRITORY LYING ADJACENT THERETO DESIGNATED AS THE "OLD LUCAS VALLEY ROAD ANNEXATION". WHEREAS, the City of San Rafael, a municipal corporation, is the owner of certain uninhabited territory described in Exhibit A attached hereto and incorporated herein by reference, which territory is contiguous to land lying within the boundary of said City; and WHEREAS, there has been filed with the City Council of the City of San Rafael a written consent under the "Annexation of Uninhabited Territory Act of 1939" by the County of Marin containing a description of uninhabited territory contiguous to territory lying within the boundary of said City of San Rafael and requesting and consenting that said territory be included in said City; and WHEREAS, it appears that it will be to the advantage, benefit and best interests of said City to annex said territory to said municipal corporation; and WHEREAS, an'application for the above described annexation has heretofore been filed with the Local Agency Formation Commission which application was presented by the City of San Rafael and County of Marin as owners of the land; and WHEREAS, the Local Agency Formation Commission, did, on the 16th day of January, 1974, approve the annexation of said uninhabited territory of the City of San Rafael and pursuant to Section 54797.1 of the Government Code of. the State of California, the said "Local Agency Formation Commission" approved and authorized the Council of the City of San Rafael to annex said territory, and to initiate de- tachment proceedings for that land lying within the Marinwood Community Services District, without notice, hearing or election by said City; and WHEREAS, the said City Council approves the annexation of the territory described as Exhibit A'Ito the City of San Rafael and elects IM to proceed with said annexation. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The said City Council hereby approves the annexation of the territory described on Exhibit A -"to the City of San Rafael, and said territory is hereby annexed to the City of San Rafael. 2. That the territory herein annexed is all that certain real property situated in the County of Marin, State of California, described on Exhibit A;lwhich territory is hereby designated as "Old Lucas Valley Road Annexation". 3. The Clerk of the City of San Rafael shall immediately prepare under the seal of the City of San Rafael, a certified copy of this Resolution, giving the date of its passage, and transmit it to the Secretary of State of California.
